MINUTES OF PROCEEDINGS

Meeting No. 44

Tuesday, December 1st, 1998

The Standing Committee on Transport met at 3:48 p.m. this day, in Room 536, Wellington Building, the Chair, Ray Bonin, presiding.

Members of the Committee present: Rob Anders, Roy Bailey, Ray Bonin, John Cannis, Roy Cullen, Bev Desjarlais, Stan Dromisky, Claude Drouin, Ovid Jackson, Stan Keyes, Paul Mercier, Lee Morrison, Lou Sekora.

In attendance: From the Parliamentary Research Branch of the Library of Parliament: John Christopher, Researcher; From the Committees and Legislative Directorate: Susan Baldwin, Legislative Clerk.

Witnesses: From the Department of Transport: Terry Burtch, Director General, Rail Safety Legislation and Program Development; Gordon Chapman, Director, Rail Safety Legislation and Program Development; Louis Gautier, Counsel, Legal Services.

The Committee proceeded to the clause by clause consideration of Bill C-58, An Act to amend the Railway Safety Act and to make a consequential amendment to another Act, pursuant to an Order of Reference of the House dated Friday, November 20, 1998.

On Clause 1

The witnesses from Transport Canada answered questions.

By unanimous consent, clauses 1, 18, 19, 20, 23, 26, 27, 34 and 35 were stood.

By unanimous consent, clauses 2 to 17 inclusive, carried.

By unanimous consent, clauses 21 and 22 carried.

By unanimous consent, clauses 24 and 25 carried.

By unanimous consent, clauses 28 to 33 inclusive, carried.

By unanimous consent, clauses 36 to 39 inclusive, carried.

By unanimous consent, the Committee reverted to stood clauses.

After debate, Clause 18 carried.

After debate, Clause 19 carried on division.

After debate, Clause 20 carried.

New Clause 20.1

Stan Dromisky moved,--That Bill C-58 be amended by adding after line 5 on page 13 the following:

"20.1 The Act is amended by adding the following after section 26.1:

Road users to give way

26.2 The users of a road shall give way to railway equipment at a road crossing if adequate warning of its approach is given."

After debate, the question being put on the amendment, it was agreed to.

On Clause 23

Stan Dromisky moved,--That Bill C-58, in Clause 23, be amended by replacing, in the English version, line 23 on page 13 with the following:

"emergency directives, rules, orders and security measures"

After debate, the question being put on the amendment, it was agreed to.

Clause 23, as amended, carried.

After debate, Clause 26 carried.

On Clause 27

Stan Dromisky moved,--That Bill C-58 be amened by replacing line 6 on page 17 by the following:

"determined by regulations made under paragraph 18(1)(c)(iii) or by any rule in force under section 19 or 20."

After debate, the question being put on the amendment, it was agreed to.

Clause 27, as amended, carried.

On Clause 34

Lee Morrison moved,--That Clause 34, line 17, the word "pollutants" be replaced by "combustion emissions".

After debate, the question being put on the amendment, it was negatived.

Clause 34 carried.

After debate, Clause 35 carried.

Clause 1 carried.

The Title carried.

The Bill, as amended, carried.

ORDERED,--That the Chair report Bill C-58, as amended, to the House on Wednesday, December 2, 1998.

At 4:23 p.m., the Committee adjourned to the call of the Chair.
