Pursuant to the order of reference of Wednesday, February 8, 2023, the committee resumed consideration of Bill C-282, An Act to amend the Department of Foreign Affairs, Trade and Development Act (supply management).

The committee commenced its clause-by-clause study of the Bill.

The Chair called Clause 1.

On Clause 1,

Tony Baldinelli moved, — That Bill C-282, in Clause 1, be amended by replacing lines 8 and 9 on page 1 with the following:

“and functions set out in subsection (2), the Minister may consider not making any commitment on behalf of the Government”

After debate, the question was put on the amendment of Tony Baldinelli and it was negatived on the following recorded division:

YEAS: Chandra Arya, Tony Baldinelli, Colin Carrie, Kyle Seeback — 4;

NAYS: Richard Cannings, Anju Dhillon, Richard Martel, Wilson Miao, Simon-Pierre Savard-Tremblay, Terry Sheehan, Arif Virani — 7.

Kyle Seeback moved, — That Bill C-282, in Clause 1, be amended

(a) by replacing lines 8 and 9 on page 1 with the following:

“and functions set out in subsection (2), if the Minister makes a commitment on behalf of the Government”

(b) by replacing, in the English version, line 11 on page 1 with the following:

“that would have one of the following effects, the Minister must include in the treaty or agreement a fair compensatory regime applicable to anyone affected by the commitment:”

The Chair ruled the proposed amendment inadmissible because it was beyond the scope of the Bill, as provided on page 770 of House of Commons Procedure and Practice, Third Edition.

Whereupon, Kyle Seeback appealed the decision of the Chair.

The question: "Shall the decision of the Chair be sustained?" was put and the decision was sustained on the following recorded division:

YEAS: Richard Cannings, Anju Dhillon, Wilson Miao, Simon-Pierre Savard-Tremblay, Terry Sheehan, Arif Virani — 6;

NAYS: Chandra Arya, Tony Baldinelli, Colin Carrie, Kyle Seeback — 4.

Chandra Arya moved, — That Bill C-282, in Clause 1, be amended by replacing line 9 on page 1 with the following:

“give due consideration to the net benefit to Canada before making any commitment on behalf of the Government”

The Chair ruled the proposed amendment inadmissible because it was contrary to the principle of the Bill, as provided on page 770 of House of Commons Procedure and Practice, Third Edition.

Whereupon, Kyle Seeback appealed the decision of the Chair.

The question: "Shall the decision of the Chair be sustained?" was put and the decision was sustained on the following recorded division:

YEAS: Richard Cannings, Anju Dhillon, Richard Martel, Wilson Miao, Simon-Pierre Savard-Tremblay, Terry Sheehan, Arif Virani — 7;

NAYS: Chandra Arya, Tony Baldinelli, Colin Carrie, Kyle Seeback — 4.

Kyle Seeback moved, — That Bill C-282, in Clause 1, be amended by adding after line 17 on page 1 the following:

“(2.2) Despite subsection (2.1), in exercising and performing the powers, duties and functions set out in subsection (2), the Minister may make a commitment on behalf of the Government of Canada, by international trade treaty or agreement, if it is likely to be beneficial to Canada.”

The Chair ruled the proposed amendment inadmissible because it was contrary to the principle of the Bill, as provided on page 770 of House of Commons Procedure and Practice, Third Edition.

Whereupon, Kyle Seeback appealed the decision of the Chair.

The question: "Shall the decision of the Chair be sustained?" was put and the decision was sustained on the following recorded division:

Colin Carrie moved, — That Bill C-282, in Clause 2, be amended by adding after line 17 on page 1 the following:

“Transitional Provision

2 Subsection 10(2.1) of the Department of Foreign Affairs, Trade and Development Act, as enacted by section 1, does not apply in respect of international trade treaties or agreements entered into or under negotiation before the day on which this Act comes into force.”

After debate, the question was put on the amendment of Colin Carrie and it was negatived on the following recorded division:
