The Standing Committee on the Status of Women met at 11:00 a.m. this day, in Room C-110, 1 Wellington Street, the Chair, Lysane Blanchette-Lamothe, presiding.

 

Members of the Committee present: Stella Ambler, Niki Ashton, Joyce Bateman, Lysane Blanchette-Lamothe, Joan Crockatt, Anne-Marie Day, Roxanne James, Tilly O'Neill Gordon, Hon. Judy Sgro and Susan Truppe.

 

Acting Members present: Jean Crowder for Sana Hassainia, Brian Jean for Wai Young and Mike Wallace for Stella Ambler.

 

Associate Members present: Hon. Carolyn Bennett.

 

In attendance: Library of Parliament: Martha Butler, Analyst. House of Commons: Philippe Méla, Legislative Clerk; David-Andrés Novoa, Legislative Clerk; Christine Holke David, Procedural Clerk.

Pursuant to the Order of Reference of Wednesday, April 17, 2013, the Committee resumed consideration of Bill S-2, An Act respecting family homes situated on First Nation reserves and matrimonial interests or rights in or to structures and lands situated on those reserves.
 

Niki Ashton moved, — That, prior to proceeding to clause-by-clause consideration of Bill S-2, the Committee invite the witnesses scheduled for Wednesday, May 8, 2013, to return before it to complete their testimony and answer questions.

Debate arose thereon.

Susan Truppe moved, — That the Committee proceed to sit in camera.

The question was put on the motion and it was agreed to on the following recorded division: YEAS: Stella Ambler, Joyce Bateman, Joan Crockatt, Roxanne James, Brian Jean, Tilly O'Neill Gordon, Susan Truppe — 7; NAYS: Niki Ashton, Jean Crowder, Anne-Marie Day, Judy Sgro — 4.

At 11:07 a.m., the sitting was suspended.

At 11:08 a.m., the sitting resumed in camera.

At 11:20 a.m., the sitting was suspended.

At 11:21 a.m., the sitting resumed in public.

 

The Committee commenced its clause-by-clause study of the Bill.

 

Andrew Beynon and Karl Jacques answered questions.

 

Pursuant to Standing Order 75(1), consideration of the Preamble and Clause 1, Short Title, were postponed.

The Chair called Clause 2.

 

After debate, Clause 2 carried by a show of hands: YEAS: 7; NAYS: 0.

On new Clause 5.1,

Judy Sgro moved, — That Bill S-2 be amended by adding after line 4 on page 6 the following new clause:

“5.1 Nothing in this Act shall be construed so as to abrogate or derogate from any aboriginal or treaty rights of the aboriginal peoples of Canada affirmed or recognized in section 35 of the Constitution Act, 1982 or given effect through any self-government agreement.”

 

After debate, the question was put on the amendment of Judy Sgro and it was negatived, by a show of hands: YEAS: 4; NAYS: 7.

 
Judy Sgro moved, — That Bill S-2 be amended by adding after line 4 on page 6 the following new clause:

“5.1 The Government of Canada recognizes the inherent right of self-government as an existing aboriginal right under section 35 of the Constitution Act, 1982. This right includes full jurisdiction over lands and land management.”

 

The Chair ruled the proposed amendment inadmissible because it was beyond the scope of the Bill, as provided on page 766 of House of Commons Procedure and Practice, Second Edition.

 

Clause 6 carried by a show of hands: YEAS: 7; NAYS: 0.

 

On Clause 7,

Judy Sgro moved, — That Bill S-2, in Clause 7, be amended by adding after line 25 on page 6 the following:

“(2.1) For greater certainty, the laws may include provisions ensuring access to the courts for their enforcement.”
