Pursuant to the order of reference of Wednesday, May 3, 2023, the committee commenced consideration of Bill C-45, An Act to amend the First Nations Fiscal Management Act, to make consequential amendments to other Acts, and to make a clarification relating to another Act.

The Chair called Clause 1.

Christopher Duschenes answered questions.

The committee commenced its clause-by-clause study of the Bill.

By unanimous consent, Clauses 1 to 26 inclusive carried severally.

On Clause 27,

Jaime Battiste moved, — That Bill C-45, in Clause 27, be amended by replacing line 19 on page 22 with the following:

“assumed by the Board following receipt of a notice un-”

The question was put on the amendment of Jaime Battiste and it was agreed to.

Clause 27, as amended, carried.

On Clause 28,

Jaime Battiste moved, — That Bill C-45, in Clause 28, be amended by replacing line 35 on page 24 with the following:

“assumed by the Board following receipt of a notice un-”

The question was put on the amendment of Jaime Battiste and it was agreed to.

Clause 28, as amended, carried.

By unanimous consent, Clauses 29 to 40 inclusive carried severally.

On Clause 41,

Jaime Battiste moved, — That Bill C-45, in Clause 41, be amended by

(a) replacing, in the English version, lines 35 and 36 on page 31 with the following:

“(2)  Subsection 86(4) of the Act is replaced by the following:”

(b)  replacing line 6 on page 32 with the following:

“(b) if, with respect to a loan secured by local revenues, the Authority receives a report of the Board un-”

(c) replacing line 22 on page 32 with the following:

“(b) if, with respect to a loan secured by other revenues, the Authority receives a report of the Board un-”

The question was put on the amendment of Jaime Battiste and it was agreed to.

Clause 41, as amended, carried.

Clause 42 carried.

On Clause 43,

Jaime Battiste moved, — That Bill C-45, in Clause 43, be amended by replacing, in the French version, line 1 on page 37 with the following:

“113b)(i), révoquer pour un motif suffisant un conseiller mentionné au para-”

The question was put on the amendment of Jaime Battiste and it was agreed to.

Clause 43, as amended, carried.

By unanimous consent, Clauses 44 to 51 inclusive carried severally.

On Clause 52,

Jaime Battiste moved, — That Bill C-45, in Clause 52, be amended by replacing, in the French version, lines 36 and 37 on page 46 with the following:

“l’emportent sur les dispositions incompatibles d’un texte législatif sur les recettes locales ou d’un texte législatif pris en vertu du paragraphe 97(1) d’une première nation.”

The question was put on the amendment of Jaime Battiste and it was agreed to.

Clause 52, as amended, carried.

On Clause 53,

Marilène Gill moved, — That Bill C-45, in Clause 53, be amended by replacing line 12 on page 47 with the following:

“(2) If there is a demand for services in a par‐”

At 3:55 p.m., the sitting resumed.

At 3:57 p.m., the sitting was suspended.

At 3:59 p.m., the sitting resumed.

After debate, the question was put on the amendment of Marilène Gill and it was agreed to.

By unanimous consent, Clauses 54 to 63 inclusive carried severally.
