Pursuant to the order of reference of Thursday, May 12, 2022, and of the motion adopted by the House on Monday, June 13, 2022, the committee resumed consideration of Bill C-11, An Act to amend the Broadcasting Act and to make related and consequential amendments to other Acts.

The witnesses answered questions.

The committee commenced its clause-by-clause study of the Bill.

Pursuant to Standing Order 75(1), consideration of Clause 1 (short title) was postponed.

The Chair called Clause 2.

On Clause 2,

John Nater moved, — That Bill C-11, in Clause 2, be amended by replacing lines 21 to 26 on page 2 with the following:

community element means the participation of members of the community, through volunteers and a community board elected by members, in the content production of community media in the language of their choice, as well as in the day-to-day operations and administration of community media that are non-profit entities responding to the needs of the community they serve; (élément communautaire)”

After debate, the question was put on the amendment of John Nater and it was negatived on the following recorded division:

YEAS: John Nater, Rachael Thomas, Tim Uppal, Kevin Waugh — 4;

NAYS: Chris Bittle, Martin Champoux, Michael Coteau, Lisa Hepfner, Anthony Housefather, Peter Julian, Tim Louis — 7.

At 11:18 a.m., the sitting was suspended.

At 11:35 a.m., the sitting resumed.

Peter Julian moved, — That Bill C-11, in Clause 2, be amended by replacing lines 21 to 26 on page 2 with the following:

“community element includes the element of the Canadian broadcasting system as part of which members of a community participate in the production of programs that are in a language used in the community including a not-for-profit broadcasting undertaking that is managed by a board of directors elected by the community;”

At 11:50 a.m., the sitting was suspended.

At 11:50 a.m., the sitting resumed.

John Nater moved, — That the amendment be amended by adding after the words “including a”, the word “predominantly”.

After debate, the question was put on the subamendment of John Nater and it was negatived on the following recorded division:

YEAS: Martin Champoux, John Nater, Rachael Thomas, Tim Uppal, Kevin Waugh — 5;

NAYS: Chris Bittle, Michael Coteau, Lisa Hepfner, Anthony Housefather, Peter Julian, Tim Louis — 6.

After debate, the question was put on the amendment of Peter Julian and it was agreed to on the following recorded division:

NAYS: Rachael Thomas — 1.

Martin Champoux moved, — That Bill C-11, in Clause 2, be amended by adding after line 29 on page 2 the following:

decision means any measure of any kind taken by the Commission. (décision)”

Debate arose thereon.

The Chair ruled the proposed amendment inadmissible because it was beyond the scope of the Bill, as provided on page 770 of House of Commons Procedure and Practice, Third Edition.

Whereupon, Martin Champoux appealed the decision of the Chair.

The question: "Shall the decision of the Chair be sustained?" was put and the decision was overturned on the following recorded division:

discoverability means the possibility for Canadians to search for and find Canadian content; (découvrabilité)”

Anthony Housefather moved, — That Bill C-11, in Clause 2, be amended by adding after line 33 on page 2 the following:

official language minority community means English-speaking communities in Quebec and French-speaking communities outside Quebec; (communauté de langue officielle en situation minoritaire)”

After debate, the question was put on the amendment of Anthony Housefather and it was agreed to on the following recorded division:

YEAS: Chris Bittle, Martin Champoux, Michael Coteau, Lisa Hepfner, Anthony Housefather, Peter Julian, Tim Louis, John Nater, Rachael Thomas, Tim Uppal, Kevin Waugh — 11;

NAYS: — 0.

The Chair ruled that the following four (4) amendments were consequential to the previous amendment and therefore they were also adopted:

That Bill C-11, in Clause 3, be amended by replacing lines 43 and 44 on page 4 with the following:

“(iii.3) enhance the vitality of official language minority communities in Canada and”

That Bill C-11, in Clause 5, be amended by replacing lines 32 and 33 on page 8 with the following:

“— and the specific needs and interests of official language minority communities in Canada and”

That Bill C-11, in Clause 5, be amended by replacing lines 11 and 12 on page 9 with the following:

“guages, including those created and produced by official language minority communities in”

That Bill C-11, in Clause 6, be amended

(a) by replacing lines 30 and 31 on page 9 with the following:

“the Commission shall enhance the vitality of official language minority communities in Canada and”

(b) by replacing lines 33 and 34 on page 9 with the following:

“5.2 (1) The Commission shall consult with official language minority communities in Canada when”
