Pursuant to the order of reference of Wednesday, March 8, 2023, the committee resumed consideration of Bill C-295, An Act to amend the Criminal Code (neglect of vulnerable adults).

Matthew Taylor answered questions.

The committee commenced its clause-by-clause study of the Bill.

The Chair called Clause 1.

On Clause 1,

Rhéal Éloi Fortin moved, — That Bill C-295, in Clause 1, be amended

(a) by replacing line 11 on page 1 with the following:

“(a) are unrelated to the owners and officers of the”

(b) by replacing line 17 on page 1 to line 10 on page 2 with the following:

officer means the chairperson of the board of directors, the president, a vice-president, the secretary, the treasurer, the comptroller, the general counsel, the general manager or a managing director of a long-term care facility, any other person who performs functions for a long-term care facility similar to those normally performed by a person occupying any of those offices, or any other person designated as an officer of a long-term care facility. (dirigeant)”

After debate, the question was put on the amendment of Rhéal Éloi Fortin and it was agreed to.

The Chair declared the following amendments consequential and therefore also carried:

That Bill C-295, in Clause 2, be amended by replacing line 14 on page 2 with the following:

“(b.1) as an owner or officer of a long-term care fa‐”

That Bill C-295, in Clause 3, be amended by replacing line 26 on page 2 with the following:

“215.1 (1) When an owner or officer of a long-term”

Clause 1, as amended, carried.

On Clause 2,

Gary Anandasangaree moved, — That Bill C-295, in Clause 2, be amended by replacing line 15 on page 2 with the following:

After debate, the question was put on the amendment of Gary Anandasangaree and it was agreed to.

Clause 2, as amended, carried.

On Clause 3,

Rhéal Éloi Fortin moved, — That Bill C-295, in Clause 3, be amended by adding after line 41 on page 2 the following:

“(1.1) For the purpose of subsection (1), the court shall take into account any penalty or measure imposed under a provincial law or policy intended to protect vulnerable adults.”

The question was put on the amendment of Rhéal Éloi Fortin and it was agreed to.

Gary Anandasangaree moved, — That Bill C-295, in Clause 3, be amended by replacing line 15 on page 3 with the following:

“for a term not exceeding four years; or”

After debate, the question was put on the amendment of Gary Anandasangaree and it was agreed to on division.

Clause 3, as amended, carried.

Clause 4 carried.

On new Clause 5,

Gary Anandasangaree moved, — That Bill C-295 be amended by adding after line 21 on page 3 the following:

“Coming into Force

5 This Act comes into force on the 30th day after the day on which it receives royal assent.”

The question was put on the amendment of Gary Anandasangaree and it was agreed to.

The Title carried on division.

The Bill, as amended, was adopted.

ORDERED, — That the Chair report the Bill, as amended, to the House.

ORDERED, — That Bill C-295, as amended, be reprinted for the use of the House of Commons at report stage.

The committee proceeded to the consideration of matters related to committee business.

On motion of Gary Anandasangaree, it was agreed, — That, for the meeting of Monday, June 19, 2023, the committee hear witnesses in relation with its study of Bill S-224.

On motion of Gary Anandasangaree, it was agreed, — That, in the context of Bill S-224, An Act to amend the Criminal Code (trafficking in persons), the deadline for the submission of amendments to the clerk be no later than Monday, June 19, 2023 at 5:30 p.m.

On motion of Gary Anandasangaree, it was agreed, — That, on Wednesday, June 21, 2023, the committee proceed to clause-by-clause consideration of Bill S-224.

At 5:08 p.m., the committee adjourned to the call of the Chair.
