Pursuant to Standing Order 108(2) and the motion adopted by the committee on Monday, October 19, 2020, the committee resumed its study of the implementation of Mi’kmaq Treaty Fishing Rights to support a moderate livelihood.

Motion

Richard Bragdon moved, — That the committee include the following documents as evidence for its current study titled "Implementation of Mi'kmaq Treaty Fishing Rights to Support a Moderate Livelihood":

• Supreme Court desision "R v Marshall (No 1) [1999] 3 S.C.R. 456" and "R v Marshall (No 2) [1999] 3 S.C.R. 533;"

• The 1760 and 1761 Peace and Friendship Treaties;

• Macdonald-Laurier Institute 2019 report titled "The Marshall Decision at 20: Two Decades of Commercial Re-Empowerment of the Micmac and Maliseet;"

• The committee’s second report from the Second Session of the 36th Parliament, titled "The Marshall Decision and Beyond: Implications for Management of the Atlantic Fisheries".

After debate, the question was put on the motion and it was agreed to on the following recorded division:

YEAS: Mel Arnold, Jaime Battiste, Terry Beech, Maxime Blanchette-Joncas, Richard Bragdon, Blaine Calkins, Serge Cormier, Ken Hardie, Gord Johns, Robert J. Morrissey, John Williamson — 11;

NAYS: — 0.

Michael Dadswell, Gary Hutchins and Melanie Sonnenberg made statements and answered questions.

At 4:18 p.m., the sitting was suspended.

At 4:31 p.m., the sitting resumed.

It was agreed, — That the witnesses scheduled for the first hour of the meeting today be invited to appear again at the next meeting.
