Pursuant to the Order of Reference of Tuesday, April 9, 2019, the Committee resumed consideration of Bill C-88, An Act to amend the Mackenzie Valley Resource Management Act and the Canada Petroleum Resources Act and to make consequential amendments to other Acts.

The Committee commenced its clause-by-clause study of the Bill.

The Chair called Clause 1.

By unanimous consent, Clauses 1 to 84 inclusive carried severally.

On Clause 85,

Wayne Stetski moved, — That Bill C-88, in Clause 85, be amended

(a) by replacing lines 25 and 26 on page 41 with the following:

“considers that it is necessary to do so in any of the following circumstances:”

(b) by adding after line 28 on page 41 the following:

“(3) Subsection 12(1) of the Act is amended by striking out “or” at the end of paragraph (b), by adding “or” at the end of paragraph (c) and by adding the following after paragraph (c):

(d) a problem that the Governor in Council considers to be of national interest.

(4) Section 12 of the Act is amended by adding the following after subsection (1):

(1.1) At least six months before an order is made under paragraph (1)(d), the Minister shall publish a notice of the proposed order in the Canada Gazette and in any other publication that the Minister considers appropriate, shall hold public consultations in all communities that may be affected by the order and shall give any other interested persons the opportunity to file with the Minister comments with respect to the proposed order.

(1.2) In the case of a proposed order that would affect an Aboriginal community, the order shall not be made unless – in accordance with Article 19 of the United Nations Declaration on the Rights of Indigenous Peoples – the Minister has obtained the consent of the representatives of that community.”

The Chair ruled the proposed amendment inadmissible because it was beyond the scope of the Bill, as provided on page 770 of House of Commons Procedure and Practice, Third Edition.

After debate, Clause 85 carried on the following recorded division:

YEAS: William Amos, Mike Bossio, T.J. Harvey, Yves Robillard, Don Rusnak — 5;

NAYS: Cathy McLeod, Wayne Stetski, Arnold Viersen, Kevin Waugh — 4.

Clause 86 carried on division.
