The Standing Committee on Justice and Human Rights met in a televised session at 11:03 a.m. this day, in Room 237-C, Centre Block, the Chair, Dave MacKenzie, presiding.

 

Members of the Committee present: Charmaine Borg, Hon. Irwin Cotler, Kerry-Lynne D. Findlay, Robert Goguen, Jack Harris, Pierre Jacob, Brian Jean, Dave MacKenzie, Brent Rathgeber, Kyle Seeback and Stephen Woodworth.

 

Acting Members present: Olivia Chow for Françoise Boivin and François Pilon for Charmaine Borg.

 

In attendance: Library of Parliament: Dominique Valiquet, Analyst; Julia Nicol, Analyst.

 

Witnesses: Criminal Lawyers' Association: Oliver Abergel, Member. Barreau du Québec: Giuseppe Battista, Lawyer and President, Committee on Criminal Law; Nicole Dufour, Lawyer and Coordinator, Criminal Law Committee. As individuals: David Chen, Owner, Lucky Moose Food Mart; Chi-Kun Shi, Lawyer.

 
Pursuant to the Order of Reference of Thursday, December 15, 2011, the Committee resumed consideration of Bill C-26, An Act to amend the Criminal Code (citizen's arrest and the defences of property and persons).
 

Oliver Abergel, Nicole Dufour, David Chen and Chi-Kun Shi made statements and, with Giuseppe Battista, answered questions.

 

Robert Goguen moved, — That the debate be now adjourned.

 

The question was put on the motion and it was agreed to on the following recorded division: YEAS: Kerry-Lynne D. Findlay, Robert Goguen, Brian Jean, Brent Rathgeber, Kyle Seeback, Stephen Woodworth — 6; NAYS: Charmaine Borg, Olivia Chow, Jack Harris, Pierre Jacob — 4.

 

At 12:27 p.m., the sitting was suspended.

At 12:37 p.m., the sitting resumed.

 
The Committee proceeded to the consideration of matters related to Committee business.
 

It was agreed, — That the Committee invite officials from the Department of Justice to appear before the Committee on Tuesday, March 6, 2012, to complete its study of Bill C-26, An Act to amend the Criminal Code (citizen’s arrest and the defences of property and persons).

 

It was agreed, — That, insofar as possible, the clause-by-clause study of Bill C-26, An Act to amend the Criminal Code (citizen’s arrest and the defences of property and persons), proceed on Tuesday, March 6, 2012, or Thursday, March 8, 2012.

 

It was agreed, — That the Minister of Justice and Attorney General of Canada, the Honourable Rob Nicholson, P.C, M.P., appear on Tuesday, March 13, 2012, regarding the Supplementary Estimates (C) 2011-12.

 

It was agreed, — That the Committee commence its study of Bill C-310, An Act to amend the Criminal Code (trafficking in persons), on Thursday, March 15, 2012.

 

At 12:48 p.m., the Committee adjourned to the call of the Chair.
