The Standing Committee on Finance met at 8:49 a.m. this day, in Room 228, La Promenade Building, the Chair, James Rajotte, presiding.

 

Members of the Committee present: Mark Adler, Guy Caron, Raymond Côté, Shelly Glover, Randy Hoback, Brian Jean, Cathy McLeod, Peggy Nash, James Rajotte, Murray Rankin and Dave Van Kesteren.

 

Acting Members present: Ted Hsu for Hon. Scott Brison.

 

In attendance: Library of Parliament: Mark Mahabir, Analyst; Michaël Lambert-Racine, Analyst. House of Commons: David-Andrés Novoa, Legislative Clerk.

 

Witnesses: Canada Revenue Agency: Michael Honcoop, Director, Special Programs and Partnership Division, Benefits Program Directorate, Assessment and Benefits Services Branch; Brian McCauley, Assistant Commissioner, Legislative Policy and Regulatory Affairs Branch.

 
Pursuant to the Order of Reference of Wednesday, March 6, 2013, the Committee resumed consideration of Bill C-462, An Act restricting the fees charged by promoters of the disability tax credit and making consequential amendments to the Tax Court of Canada Act.
 

Ted Hsu moved, — That the Committee delay its clause-by-clause consideration of Bill C-462 until after the Committee has spent at least half an hour questioning witnesses, who are independent of the government, on the subject of Bill C-462.

After debate, the question was put on the motion and it was negatived, by a show of hands: YEAS: 5; NAYS: 6.

 

The Committee commenced its clause-by-clause study of the Bill.

 

Brian McCauley answered questions.

 

Pursuant to Standing Order 75(1), consideration of Clause 1, Short Title, was postponed.

The Chair called Clause 2.

 

On Clause 2,

Cathy McLeod moved, — That Bill C-462, in Clause 2, be amended by adding after line 8 on page 2 the following:

““person” has the same meaning as in subsection 248(1) of the Income Tax Act.”

 

After debate, the question was put on the amendment of Cathy McLeod and it was agreed to, by a show of hands: YEAS: 10; NAYS: 0.

 

Clause 2, as amended, carried.

 

On Clause 3,

Cathy McLeod moved, — That Bill C-462, in Clause 3, be amended by replacing line 18 on page 2 with the following:

“equal to the total of $1,000 and the amount”

 

After debate, the question was put on the amendment of Cathy McLeod and it was agreed to, by a show of hands: YEAS: 11; NAYS: 0.

 

After debate, Clause 3, as amended, carried.

 

Clause 4 carried.

 

Clause 5 carried.

 

On Clause 6,

Cathy McLeod moved, — That Bill C-462, in Clause 6, be amended by replacing, in the English version, line 9 on page 3 with the following:

“Minister under section 4 or who contravenes”

 

After debate, the question was put on the amendment of Cathy McLeod and it was agreed to.

 

Clause 6, as amended, carried.

 

Clause 7 carried.

 

On Clause 8,

Cathy McLeod moved, — That Bill C-462, in Clause 8, be amended by replacing lines 23 and 24 on page 3 with the following:

“not apply to information or documents that can reasonably be regarded as necessary for the administration or enforcement of this”

 

After debate, the question was put on the amendment of Cathy McLeod and it was agreed to, by a show of hands: YEAS: 11; NAYS: 0.

 

Clause 8, as amended, carried.

 

On Clause 9,

Cathy McLeod moved, — That Bill C-462, in Clause 9, be amended by replacing, in the French version, line 38 on page 3 with the following:

“tion d’aviser le ministre prévue à l’article”

 

The question was put on the amendment of Cathy McLeod and it was agreed to, by a show of hands: YEAS: 11; NAYS: 0.

 

Clause 9, as amended, carried.

 

Clause 10 carried.

 

Clause 11 carried.

 

Clause 12 carried.

 

Clause 1, Short Title, carried.

 

The Title carried.

 

The Bill, as amended, carried.
