The Standing Committee on Access to Information, Privacy and Ethics met at 9:01 a.m. this day, in Room 213, Wellington Building, the Chair, Paul Szabo, presiding.

 

Members of the Committee present: Patricia Davidson, Bob Dechert, Carole Freeman, Pierre Poilievre, Greg Rickford, Bill Siksay, Michelle Simson, Paul Szabo and Borys Wrzesnewskyj.

 

Acting Members present: Dean Del Mastro for Kelly Block and Jean Dorion for Luc Desnoyers.

 

In attendance: Library of Parliament: Élise Hurtubise-Loranger, Analyst; Alysia Davies, Analyst.

 

Witnesses: Office of the Information Commissioner of Canada: Lisa M. Campbell, Interim Assistant Information Commissioner, Policy, Communication and Operations; Suzanne Legault, Interim Information Commissioner; Andrea Neill, Assistant Commissioner, Complaints Resolution and Compliance.

 

At 9:02 a.m., the sitting was suspended.

At 9:19 a.m., the sitting resumed.

 
Pursuant to Standing Order 32(5), the Committee commenced consideration of the Annual Report of the Information Commissioner for the fiscal year ended March 31, 2009, referred to the Committee on Monday, April 6, 2009.
 

Suzanne Legault made a statement and, with the other witnesses, answered questions.

 

A point of order was raised regarding the relevance of Dean Del Mastro's intervention.

RULING BY THE CHAIR

The Chair ruled that the statements made by Dean Del Mastro were not relevant because they did not address the business before the Committee at the time.

 

Whereupon, Dean Del Mastro appealed the decision of the Chair.

The question: "Shall the decision of the Chair be sustained?" was put and the decision was sustained on the following recorded division:YEAS: Jean Dorion, Carole Freeman, Bill Siksay, Michelle Simson, Borys Wrzesnewskyj — 5; NAYS: Patricia Davidson, Bob Dechert, Dean Del Mastro, Pierre Poilievre, Greg Rickford — 5.

The Chair's decision was sustained as the question was not negatived.

 

At 10:58 a.m., the sitting was suspended.

At 11:07 a.m., the sitting resumed.

 

Dean Del Mastro moved, — That the meeting be extended by 15 minutes.

 

The question was put on the motion and the result of the vote was announced: YEAS: 5; NAYS: 5.

Whereupon, the Chair voted in the negative.

Accordingly, the motion was negatived.

 

At 12:01 p.m., the Committee adjourned to the call of the Chair.
