The Standing Committee on Aboriginal Affairs and Northern Development met at 9:02 a.m. this day, in Room 536, Wellington Building, the Chair, Bruce Stanton, presiding.

 

Members of the Committee present: Harold Albrecht, Hon. Larry Bagnell, Hon. Mauril Bélanger, Rob Clarke, Jean Crowder, John Duncan, Marc Lemay, Yvon Lévesque, LaVar Payne, Greg Rickford, Todd Norman Russell and Bruce Stanton.

 

In attendance: Library of Parliament: Mary Hurley, Analyst; Marlisa Tiedemann, Analyst. House of Commons: Mike MacPherson, Legislative Clerk.

 

Witnesses: Department of Indian Affairs and Northern Development : John Dempsey, Director, Policy, Indian Oil and Gas Canada; Karl Jacques, Senior Counsel.

 
Pursuant to the Order of Reference of Friday, February 13, 2009, the Committee resumed consideration of Bill C-5, An Act to amend the Indian Oil and Gas Act.
 

The Committee commenced its clause-by-clause study of the Bill.

 

The Chair called Clause 1.

 

Clause 1 carried.

 

Clause 2 carried.

 

On Clause 3,

Mauril Bélanger moved, — That Bill C-5, in Clause 3, be amended by adding after line 13 on page 21 the following:

“ANNUAL REPORT TO PARLIAMENT

28.1. One year after the coming into force of this section and every year after that, the Minister shall prepare a report on the administration of this Act during the preceding year. The Minister shall table a copy of the report in each House of Parliament within the first fifteen days that it is sitting after the completion of the report, which shall include a summary of the regulations made under this Act and describe any variations in the regulations from province to province.”

Debate arose thereon.

 

By unanimous consent, the amendment was allowed to stand.

 
Jean Crowder moved, — That Bill C-5, in Clause 3, be amended by adding after line 13 on page 21 the following:

“REPORT TO PARLIAMENT

28.1 At least every two years after the coming into force of the present section, the Minister shall prepare a report on the administration of this Act during the two preceding years and shall table a copy of the report in each House of Parliament within the first fifteen days that it is sitting after the completion of the report, which shall include a summary addressing the following matters:

(a) the progress of the consultations mentioned in paragraph 6(1.1)(a) and a list of concerns raised during such consultations;

(b) any proposed regulation to be made under subsection 6(1.1); and

(c) any regulations made under this Act.”

Debate arose thereon.

 

The witnesses made statements and answered questions.

 

Mauril Bélanger moved, — That the amendment be amended by adding after the words “made under this Act” the following:

“ and describe any variations in the regulations from province to province”

 

After debate, the question was put on the subamendment of Mauril Bélanger and it was agreed to.

 

The question was put on the amendment of Jean Crowder, as amended, and it was agreed to.

 

Clause 3, as amended, carried.

 

Clause 4 carried.

 

The Title carried.

 

The Bill , as amended, carried.

 

ORDERED, — That the Chair report the Bill, as amended, to the House.

 

ORDERED, — That Bill C-5, as amended, be reprinted for the use of the House at report stage.
