The Standing Committee on Industry, Science and Technology met in a televised session at 3:44 p.m. this day, in Room 269, West Block, the Chair, James Rajotte, presiding.

 

Members of the Committee present: Colin Carrie, Paul Crête, Hon. Jean C. Lapierre, Brian Masse, Hon. Dan McTeague, James Rajotte, Bev Shipley, Hon. Belinda Stronach, Dave Van Kesteren and Robert Vincent.

 

Acting Members present: Hon. Larry Bagnell for Susan Kadis, Hon. Larry Bagnell for Hon. Belinda Stronach and Massimo Pacetti for Susan Kadis.

 

Other Members present: Michel Guimond.

 

In attendance: Library of Parliament: Sheena Starky, Analyst; Andrew Kitching, Analyst. House of Commons: Michael Lukyniuk, Principal Clerk, Legislative Services.

Pursuant to the Order of Reference of Monday, November 6, 2006, the Committee commenced consideration of Bill C-26, An Act to amend the Criminal Code (criminal interest rate).
 

The witnesses made statements and answered questions.

 

Colin Carrie moved, — Department officials from Justice and Industry have fully explained the rationale for Bill C-26, An act to Amend the Criminal Code (criminal interest rate) and it's benefit for the protection to Canadian consumers. This bill is supported by the payday lending industry as it gives legal certainty to the industry. Bill C-26 is generally supported by the provinces because it allows them the option to regulate payday lenders through an exemption from section 347 of the Criminal Code to those that have measures in place to protect borrowers. I move that the Committee is ready to continue through the clause-by-clause review of B C-26, with the objective of completing our review, and sending the bill back to the House of Commons today.

 

Paul Crête moved, — That the motion be amended by adding after the word “provinces” the following, “with the exception of Québec”.

Debate arose thereon.

 

A point of order was raised regarding the procedural admissibility of the proposed motion.

 

The Chair ruled the proposed motion admissible.

 

Whereupon, Dan McTeague appealed the decision of the Chair.

The question: "Shall the decision of the Chair be sustained?" was put and the decision was overturned on the following recorded division: YEAS: Paul Crête, Robert Vincent — 2; NAYS: Larry Bagnell, Colin Carrie, Jean C. Lapierre, Brian Masse, Dan McTeague, Bev Shipley, Belinda Stronach, Dave Van Kesteren — 8.

 

Dan McTeague moved, — That the Committee move to clause-by-clause.

 

Colin Carrie moved, — That the motion be amended by adding after the words “clause-by-clause” the following, “immediately”.

Debate arose thereon.

 

Paul Crête moved, — That the amendment be amended by adding after the word “immediately” the following, “after the Committee has heard all the witnesses the Members wish to invite”.

Debate arose thereon.

 

The question was put on the subamendment of Paul Crête and it was negatived on the following recorded division:YEAS: Paul Crête, Robert Vincent — 2; NAYS: Larry Bagnell, Colin Carrie, Jean C. Lapierre, Brian Masse, Dan McTeague, Massimo Pacetti, Bev Shipley, Dave Van Kesteren — 8.

 

The Committee resumed consideration of the motion of Colin Carrie, — That the motion be amended by adding after the words “clause-by-clause” the following, “immediately”.

 

The question was put on the motion and it was agreed to on the following recorded division: YEAS: Larry Bagnell, Colin Carrie, Jean C. Lapierre, Brian Masse, Dan McTeague, Massimo Pacetti, Bev Shipley, Dave Van Kesteren — 8; NAYS: Paul Crête, Robert Vincent — 2.

 

The question was put on the motion, as amended, and it was agreed to on the following recorded division: YEAS: Larry Bagnell, Colin Carrie, Jean C. Lapierre, Brian Masse, Dan McTeague, Massimo Pacetti, Bev Shipley, Dave Van Kesteren — 8; NAYS: Paul Crête, Robert Vincent — 2.

 

The Committee commenced its clause-by-clause study of the Bill.

 

The Chair called Clause 1.

 

Clause 1 carried on division.

The Title carried on division.

 

The Bill carried on division.

 

ORDERED, — That the Chair report the Bill to the House.
