The Standing Committee on Human Resources, Social Development and the Status of Persons with Disabilities met at 3:35 p.m. this day, in Room 209, West Block, the Chair, Dean Allison, presiding.

 

Members of the Committee present: Dean Allison, Patrick Brown, Hon. Michael D. Chong, Ruby Dhalla, Mike Lake, Yves Lessard, Michael Savage, Mario Silva and Lynne Yelich.

 

Acting Members present: Hon. Carolyn Bennett for Gary Merasty, Chris Charlton for Tony Martin, Raymond Gravel for France Bonsant and Hon. Gurbax Malhi for Gary Merasty.

Pursuant to the Order of Reference of Tuesday, January 30, 2007, the Committee commenced consideration of Bill C-36, An Act to amend the Canada Pension Plan and the Old Age Security Act.
 

The Committee commenced its clause-by-clause study of the Bill.

 

The Chair called Clause 1.

Clause 3 carried.

 

On Clause 4,

Yves Lessard moved, — That Bill C-36, in Clause 4, be amended by replacing line 36 on page 2 with the following:

“recoverable within six years in the Federal Court or”

 

At 3:53 p.m., the sitting was suspended.

At 3:59 p.m., the sitting resumed.

 

After debate, the question was put on the amendment of Yves Lessard and it was negatived.

 
Yves Lessard moved, — That Bill C-36, in Clause 4, be amended by replacing line 41 on page 2 with the following:

“recoverable within six years in the Federal Court or”

Clauses 5 to 10 inclusive carried severally.

 

On Clause 11,

Yves Lessard moved, — That Bill C-36, in Clause 11, be amended by deleting lines 8 to 10 on page 8.

 

After debate, the question was put on the amendment of Yves Lessard and it was negatived on the following recorded division: YEAS: Raymond Gravel, Yves Lessard — 2; NAYS: Carolyn Bennett, Patrick Brown, Chris Charlton, Michael D. Chong, Ruby Dhalla, Mike Lake, Michael Savage, Lynne Yelich — 8.

 

Clause 11 carried.

 

Clauses 12 to 15 inclusive carried severally.

 

On Clause 15.1,

Yves Lessard moved, — That Bill C-36 be amended by adding after line 9 on page 12 the following new clause:

“15.1 Section 8 of the Act is amended by adding the following after subsection (1):

(1.1) The first pension payment to any person shall include an application for payment of a supplement referred to in subsection 11(2).”

Debate arose thereon.

 

The Chair ruled the proposed amendment inadmissible because it sought to amend sections of the parent Act not amended by the Bill, as provided on page 654 of House of Commons Procedure and Practice.

 

On Clause 16,

Yves Lessard moved, — That Bill C-36, in Clause 16, be amended by replacing line 12 on page 12 with the following:

“(4) The Minister shall waive the requirement”

 

After debate, the question was put on the amendment of Yves Lessard and it was negatived on the following recorded division: YEAS: Raymond Gravel, Yves Lessard — 2; NAYS: Carolyn Bennett, Patrick Brown, Chris Charlton, Michael D. Chong, Ruby Dhalla, Mike Lake, Michael Savage, Mario Silva, Lynne Yelich — 9.

 
Yves Lessard moved, — That Bill C-36, in Clause 16, be amended by adding after line 18 on page 12 the following:

“(1.1) Paragraph 11(7)(a) of the Act is repealed.”

 

The Chair ruled the proposed amendment inadmissible because it infringed on the financial initiative of the Crown, as provided on page 655 of House of Commons Procedure and Practice.

 
Chris Charlton moved, — That Bill C-36, in Clause 16, be amended by deleting lines 19 to 24 on page 12.

 

After debate, the question was put on the amendment of Chris Charlton and it was negatived on the following recorded division: YEAS: Chris Charlton, Raymond Gravel, Yves Lessard — 3; NAYS: Carolyn Bennett, Patrick Brown, Michael D. Chong, Ruby Dhalla, Mike Lake, Michael Savage, Mario Silva, Lynne Yelich — 8.

By unanimous consent, it was agreed, — That the result of the vote on a previous amendment be applied to the following amendment which is therefore also negatived:

That Bill C-36, in Clause 17, be amended by replacing line 27 on page 12 with the following:

“(1.01) The Minister shall waive the require-”

On Clause 18,

 

By unanimous consent, it was agreed, — That the result of the vote on a previous amendment be applied to the following two (2) amendments which are therefore also negatived:

That Bill C-36, in Clause 18, be amended by replacing line 40 on page 17 with the following:

“(2.1) The Minister shall waive the require-”

That Bill C-36, in Clause 18, be amended by replacing line 1 on page 18 with the following:

“(2.2) The Minister shall waive the require-”

By unanimous consent, it was agreed, — That the result of the vote on a previous amendment be applied to the following amendment which is therefore also negatived:

That Bill C-36, in Clause 19, be amended by replacing line 9 on page 18 with the following:
