The Legislative Committee on Bill C-30 met at 12:17 p.m. this day, in Room 362, East Block, the Chair, Laurie Hawn, presiding.

 

Members of the Committee present: Bernard Bigras, Nathan Cullen, Claude DeBellefeuille, Hon. John Godfrey, Laurie Hawn, Mark Holland, Brian Jean, Fabian Manning, David J. McGuinty, Francis Scarpaleggia, David Tilson, Mark Warawa and Jeff Watson.

 

In attendance: House of Commons: Joann Garbig, Legislative Clerk; Marc Toupin, Legislative Clerk. Library of Parliament: Tim Williams, Analyst; Sam Banks, Analyst.

Pursuant to the Order of Reference of Monday, December 4, 2006, the Committee resumed consideration of Bill C-30, An Act to amend the Canadian Environmental Protection Act, 1999, the Energy Efficiency Act and the Motor Vehicle Fuel Consumption Standards Act (Canada's Clean Air Act).
 

The Committee resumed its clause-by-clause study of the Bill.

 

The Committee resumed consideration of Clause 27 and the amendment of Bernard Bigras, as follows: — That Bill C-30, in Clause 27, be amended by replacing line 23 on page 27 with the following: “who fails to remit a tradeable unit—other than a tradeable unit in respect of greenhouse gases—to the”

 

By unanimous consent, the amendment was withdrawn.

 

Clause 27 carried.

 

After debate, Clause 28 carried.

 

Clause 29 carried.

 

After debate, Clause 30 was negatived by a show of hands: YEAS: 0; NAYS: 7.

 

Clause 31 carried.

 

On Clause 32,

John Godfrey moved, — That Bill C-30, in Clause 32, be amended by replacing line 29 on page 28 with the following:

“subsection 93(1), 103.05(2) or 103.07(2)(b) or section 118 or”

 

After debate, the question was put on the amendment of John Godfrey and it was agreed to, by a show of hands: YEAS: 7; NAYS: 5.

 

Clause 32, as amended, carried by a show of hands: YEAS: 7; NAYS: 2.

 

On Clause 33,

John Godfrey moved, — That Bill C-30, in Clause 33, be amended by replacing line 6 on page 29 with the following:

“subsection 93(1) or section 118,”

 

The question was put on the amendment of John Godfrey and it was agreed to, by a show of hands: YEAS: 7; NAYS: 5.

 

Clause 33, as amended, carried by a show of hands: YEAS: 7; NAYS: 5.

 

On Clause 34,

John Godfrey moved, — That Bill C-30, in Clause 34, be amended by replacing line 22 on page 29 with the following:

“93(1) or section 140, 167, 177 or”

 

The question was put on the amendment of John Godfrey and it was agreed to, by a show of hands: YEAS: 7; NAYS: 5.

“93(1) or section 167, 177 or 326”

 

By unanimous consent, the amendment was allowed to stand.

David J. McGuinty moved, — That Bill C-30 be amended by adding before line 1 on page 31 the following new clause:

“41.1 The Energy Efficiency Act is amended by replacing, before section 1, the words “Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows” with the following:

WHEREAS the Government of Canada is committed to ensuring sustained improvement in the efficient use of energy in all sectors of the Canadian economy;

NOW, THEREFORE, Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:”

 

After debate, the question was put on the amendment of David J. McGuinty and it was agreed to, by a show of hands: YEAS: 12; NAYS: 0.

 

After debate, Clause 42 carried by a show of hands: YEAS: 12; NAYS: 0.

 

After debate, Clause 43 carried by a show of hands: YEAS: 12; NAYS: 0.

 

After debate, Clause 44 carried by a show of hands: YEAS: 12; NAYS: 0.

 

Clause 45 carried by a show of hands: YEAS: 12; NAYS: 0.
