Meeting No. 37

Wednesday, April 9, 2003

The Standing Committee on Industry, Science and Technology met at 3:31 p.m. this day, in Room 701, La Promenade Building, the Chair, Walt Lastewka, presiding.

Members of the Committee present: Larry Bagnell, Brian Fitzpatrick, Walt Lastewka, Brian Masse, Dan McTeague, Hon. Gilbert Normand, James Rajotte, Andy Savoy and Brent St. Denis.

Acting Member present: Michel Guimond for Paul Crête.

In attendance: From the Library of Parliament: Geoffrey P. Kieley and Dan Shaw, Research Officers.

Witnesses: From the Canadian Bar Association: Tim J. Kennish, Past Chair, National Competition Law Section; Tamra L. Thomson, Director, Legislation and Law Reform. From the As Individual: Robert S. Russell, Lawyer, Borden Ladner Gervais; Roger Ware, Professor, Queen's University.

Pursuant to its Order of Reference of Thursday, October 24, 2002, the Committee resumed consideration of Bill C-249, An Act to amend the Competition Act (See Minutes of Proceedings, Monday, March 31, 2003, Meeting No. 33).

Tamra Thomson and Tim Kennish each made an opening statement and answered questions.

Robert Russell made an opening statement and answered questions.

Roger Ware made an opening statement and answered questions.

At 5:11 p.m., the sitting was suspended.

At 5:12 p.m., the sitting resumed.

The Committee proceeded in camera to consider its future business.

It was agreed, -- That the Committee resume its study of Bill C-249, An Act to amend the Competition Act on April 28, 2003.

It was agreed, -- That according to the motion adopted on February 17, 2003, the Committee summon representatives of the oil companies and other experts so that it can explore possible causes of the recent increase in the price of gasoline, and the significant negative effects that the increase is having on the economy, and can recommend appropriate corrective measures to the federal government on May 6th, 7, 12 and 13, 2003.

It was agreed, -- That the Committee resume its study on the Potential Economic Impact on Canadian Industry of Implementing the Kyoto Protocol on April 29 and 30, 2003.

It was agreed, -- That the Committee invites the Minister of Industry and the Secretaries of State on the Main Estimates 2003 – 2004 on May 5th, 8, 14, 26 and 28, 2003.

It was agreed, -- That according to the motion adopted on December 3, 2002, the Committee undertake a study on the alleged abuse of the Automatic Injunction Provision within the Patent Act on June 2, 3 and 4, 2003.

It was agreed, -- That the Committee meet in camera on June 9 and 11, 2003.

It was agreed, -- That the proposed budget in the amount of $12,000 be adopted and that the Chair present the said budget to the Subcommittee on Committee Budgets of the Liaison Committee.

At 5:29 p.m., the Committee adjourned to the call of the Chair.
