Meeting No. 33

Monday, March 31, 2003

The Standing Committee on Industry, Science and Technology met at 3:30 p.m. this day, in Room 308, West Block, the Chair, Walt Lastewka, presiding.

Members of the Committee present: André Bachand, Larry Bagnell, Brian Fitzpatrick, Walt Lastewka, Serge Marcil, Brian Masse, Dan McTeague, Hon. Gilbert Normand, James Rajotte, Brent St. Denis and  Paddy Torsney.

Acting Members present: Stéphane Bergeron for Paul Crête, Sébastien Gagnon for Jocelyne Girard-Bujold, Judy Sgro for Brent St. Denis, Lynn Myers for Paddy Torsney, Janko Perić for Joseph Volpe, Marlene Jennings for Gilbert Normand and Judy Sgro for Andy Savoy.

In attendance: From the Library of Parliament: Geoffrey P. Kieley and Dan Shaw, Research Officers.

Witnesses: From the House of Commons: Dan McTeague, Pickering--Ajax--Uxbridge. From the Department of Industry: Konrad von Finckenstein, Commissioner of Competition, Competition Bureau; Gaston Jorré, Senior Deputy Commissioner of Competition, Mergers Branch, Competition Bureau; Peter Sagar, Deputy commissioner of Competition, Competition Policy Branch.

Pursuant to its Order of Reference of Thursday, October 24, 2002, the Committee proceeded to the consideration of Bill C-249, An Act to amend the Competition Act.

Dan McTeague made an opening statement and answered questions.

At 4:19 p.m., the sitting was suspended.

At 4:20 p.m., the sitting resumed.

Konrad von Finckenstein made an opening statement and, with the other witnesses, answered questions.

Dan McTeague moved the following amendment, -- That, in respecting the intent of the order made by the Committee on December 3, 2002:

 

“that the House of Commons Standing Committee on Industry, Science and Technology review the automatic injunction notice of compliance Regulations under the Patent Act at its earliest opportunity”,

 

the Committee commence its consideration immediately after its study of Bill C-249.

And debate arose.

Serge Marcil moved the following amendment, -- That the motion be amended by adding “by inviting the Department of Industry, the Department of Health only and by holding an in camera meeting.

After debate, the question being put on the amendment, it was negatived by a show of hands.
