Meeting No. 7

Wednesday, December 4, 2002

The Standing Committee on Environment and Sustainable Development met at 3:40 p.m. this day, in Room 308, West Block, the Chair, The Hon. Charles L. Caccia, presiding.

Members of the Committee present: Roy Bailey, The Hon. Charles L. Caccia, Serge Cardin, John Herron, Nancy Karetak-Lindell, Karen Kraft Sloan, Rick Laliberte, Gary Lunn, Karen Redman, Julian Reed, Andy Savoy.

Acting Members present: Brian Masse for Joe Comartin, Judy Longfield for Alan Tonks, Gilbert Normand and John Finlay for Hélène Scherrer.

In attendance: From the Research Branch of the Library of Parliament: Kristen Douglas and Tim Williams, analysts.

Witnesses: From the Canadian Environmental Assessment Agency: Robert G. Connelly, Vice-President, Policy Development; Heather Smith, Senior Counsel, Legal Services.

Pursuant to its Order of Reference of Monday, October 7, 2002, the Committee resumed consideration of Bill C-9, An Act to amend the Canadian Environmental Assessment Act (See Minutes of Proceedings, Thursday, November 7, 2002, Meeting No. 2).

The Committee proceeded to Clause-by-Clause consideration of the Bill.

On Clause 26,

The witnesses answered questions.

Clause 26 stood.

Clause 27 carried.

On Clause 28,

Karen Redman moved, -- That Bill C-9, in Clause 28, be amended by replacing lines 34 and 35 on page 24 with the following:

"Agency with any information respecting the assessments whose conduct they ensure under this Act"

The question being put on the amendment, it was adopted.

Clause 28, as amended, carried.

At 4:30 p.m., the Vice-Chair, Karen Kraft Sloan took the chair.

On Clause 29,

Charles L. Caccia moved, -- That Bill C-9, in Clause 29, be amended by replacing line 39 on page 24 with the following:

‘‘29. (1) Subsection 58(1) of the Act is amended by stricking out the word ‘‘and’’ at the end of paragraph (g), by adding the word ‘‘and’’ at the end of paragraph (h) and by adding the following after paragraph (h):

(i) make regulations prescribing any project or class of projects for which a comprehensive study is required where the Minister is satisfied that the project or any project within that class is likely to have significant adverse environmental effects.

(2) Subsection 58(1.1) of the Act is’’

The result of the vote was announced.

YEAS: 6

NAYS: 6

The Vice-Chair voted in the affirmative.

Accordingly, the amendment carried.

At 4:55 p.m., the Chair, Charles Caccia took the Chair.

Karen Redman moved, -- That Bill C-9, in Clause 29, be amended by replacing, in the French version, line 2 on page 25 with the following:

"la présente loi, un programme d'aide financière pour faciliter la participation du"

The question being put on the amendment, it was adopted.

Clause 29, as amended, carried.

On Clause 30,

Gary Lunn moved, -- That Bill C-9, in Clause 30, be amended by replacing lines 13 to 27 on page 25 with the following:

‘‘(2) Section 59 of the Act is amended by adding the following after paragraph (c):’’

After debate, the question being put on the amendment, it was negatived on division.

Serge Cardin moved, -- That Bill C-9, in Clause 30, be amended

(a) by replacing lines 22 and 23 on page 25 with the following:

"physical works, have insignificant"

(b) by replacing lines 42 and 43 on page 25 with the following:

"physical work, have insignificant"

After debate, the question being put on the amendment, it was negatived by a show of hands.

YEAS: 3

NAYS: 5

Karen Redman moved, -- That Bill C-9, in Clause 30, be amended by replacing, in the French version, line 31 on page 25 with the following:

"règlement précise, individuellement ou par catégorie, ou de l'Agence canadien-"

The question being put on the amendment, it was adopted.

The Chair ruled that the following motion is consequential to an amendment that was adopted in Clause 29:

That Bill C-9, in Clause 30, be amended by adding after line 47 on page 25 the following:

‘‘(2.1) Paragraph 59(d) of the Act is repealed.’’

Accordingly, the amendment was adopted.

Karen Redman moved, -- That Bill C-9, in Clause 30, be amended by adding after line 10 on page 26 the following:

"(3.1) Subparagraph 59(i)(ii) of the Act is replaced by the following:

(ii) projects to be carried out outside Canada and either outside of federal lands or on federal lands described in paragraph (a) of the definition "federal lands" in subsection 2(1),"

The question being put on the amendment, it was adopted.

Clause 30, as amended, stood.

At 5:30 p.m., the Committee adjourned to the call of the Chair.
