MINUTES OF PROCEEDINGS

Meeting No. 7

Tuesday, November 26, 2002

The Standing Committee on Citizenship and Immigration met in camera at 9:16 a.m. this day, in Room 705, La Promenade Building, the Chair, Joe Fontana, presiding.

Members of the Committee present: Diane Ablonczy, Madeleine Dalphond-Guiral, Joe Fontana, Inky Mark, Anita Neville, Jerry Pickard, Judy Wasylycia-Leis, Lynne Yelich.

Acting Member present:  Stan Dromisky for David Price.

In attendance: In attendance: From the Library of Parliament: Benjamin Dolin and Margaret Young; Researchers.

Witnesses: Benjamin Dolin and Margaret Young.

Pursuant to its mandate under Standing Order 108(2), the Committee commenced its study on  a Draft Report “The Safe Third Country Regulations”

The witnesses answered questions.

By unanimous consent at: 9:36 the Committee proceeded to sit in public.

On motion of Anita Neville,it was agreed - That, as established by the Board of Internal Economy and if requested, reasonable travelling, accommodation, and living expenses be reimbursed to witnesses who are invited to appear before the Committee up to a maximum of 2 representatives for any organization.

On motion of Anita Neville, it was agreed - That, pursuant to Standing Order 111(4), whenever an Order in council for appointment or a certificate of nomination for appointment is referred to the Committee, the Clerk shall obtain and circulate to each member of the Committee a copy of the resume of each appointee.

On motion of Anita Neville, it was agreed - That the Chair be authorized to seek an Order of Reference from the House of Commons for the Committee’s travel in January and February 2003 so that the Committee can hold hearings on, Provincial Nominees, Settlement Programs, C-18 and National Identity Card and to Washington, D.C. in relation to its study on security at points of entry in Canada.

On motion of Jerry Pickard, it was agreed - That the Chair be authorised to plan and finalize the budgets and itineraries for the Committee’s travel in January and February 2003 to all Provincial Capitals and other cities if deemed necessary and to Washington, D.C. and that the Chair present the said budgets to the Sub-committee on budgets of the Liaison Committee.

On motion of Jerry Pickard, it was agreed - That the researchers be authorised to compile a list of potential witnesses, that the committee would hear during their travel in January and February 2003 and also prepare a brief outline on the issues the Committee would like the witnesses to address.

On motion of Anita Neville, it was agreed - That six members of the Standing Committee on Citizenship and Immigration and or associate Members hold hearing in St. John’s, Charlottetown, Halifax, Fredericton and Quebec City and any other city deemed necessary and that the membership be composed of 2 Liberals, 1 Canadian Alliance, 1 Bloc Quebecois, 1 NDP and 1 PC and that the necessary staff accompagny the Committee.

On motion of Anita Neville, it was agreed - That six members of the Standing Committee on Citizenship and Immigration and or associate Members hold hearings in Victoria, Edmonton, Saskatoon, Winnipeg, Toronto and any other city if deemed necessary and that the membership be composed of 2 Liberals, 1 Canadian Alliance, 1 Bloc Quebecois, 1 NDP and 1 PC that the necessary staff do accompany the Committee.

On motion of Anita Neville, it was agreed - That the documents entitled :

 

·        UNHCR Comments on the Draft Agreement between Canada and the United States of America for « Cooperation in the Examination of Refugee Status Claims from Nationals of Third Countries », dated July 26, 2002,(Appendix1) and

 

·        Report by David A. Martin, Doherty Professor of Law and Weber Research Professor of Civil Liberties and Human Rights, University of Virginia, dated July 15, 2002, (Appendix 2)

 

be appended to the evidence presented before the Standing Committee on Citizenship and Immigration on Thursday, November 21, 2002.

By unanimous consent at 9:44 the Committee proceeded to sit in camera.

The Committee resumed discussion on a Draft Report”The Safe Third Country Regulations”.

The witnesses answered questions.

At 11:48 a.m., the Committee adjourned to the call of the Chair.
