The Standing Committee on Aboriginal Affairs, Northern Development and Natural Resources met at 11:10 a.m. this day, in Room 308, West Block, the Chair, Nancy Karetak-Lindell, presiding.

Members of the Committee present: Larry Bagnell, Gérard Binet, Serge Cardin, Jean-Guy Carignan, David Chatters, Rodger Cuzner, John Finlay, John Godfrey, Nancy Karetak-Lindell, Gerald Keddy, Benoît Serré, Guy St-Julien, Maurice Vellacott.

Acting Members present: Charles Hubbard for John Godfrey; Shawn Murphy for Larry Bagnell.

Pursuant to its Order of Reference of Tuesday, February 20, 2001, the Committee resumed consideration of Bill C-4, An Act to establish a foundation to fund sustainable development technology (See Minutes of Proceedings, Tuesday, March 13, 2001, Meeting No. 3).

The Committee proceeded to Clause-by-Clause consideration of the Bill.

Pursuant to Standing Order 75(1), consideration of Clause 1 was postponed.

On Clause 2,

Serge Cardin proposed to move the following three amendments:

-- That Bill C-4, in Clause 2, be amended by replacing line 21 on page 1 with the following:

"sues, but excluding those using nuclear technologies."

-- That Bill C-4, in Clause 2, be amended by replacing lines 19 to 21 on page 1 with the following:

"able development by reducing greenhouse gases and to stimulate international sales, but excluding those using nuclear technologies."

Gerald Keddy moved, -- That Bill C-4, in Clause 10, be amended by replacing line 40 on page 6 with the following:

On Clause 15,

Benoit Serré moved, -- That Bill C-4, in Clause 15, be amended by replacing, in the English version, line 13 on page 10 with the following:

(iii) not-for-profit organizations;

Clause 15, as amended, carried.

Clauses 16 to 18 carried severally.

On Clause 19,

Gerald Keddy moved, -- That Bill C-4, in Clause 19, be amended by replacing lines 16 to 25 on page 11 with the following:

19. (1) Subject to subsection (1.1), the Foundation may, from its funds, provide funding to eligible recipients to be used by them solely for the purposes of eligible projects in accordance with any terms and conditions specified by the Foundation in respect of the funding, including terms and conditions as to repayment of the funding, when applicable, intellectual property rights and the maximum amount and proportion of funding for eligible projects to be provided by the Foundation.

(1.1) Funding provided by the Foundation under subsection (1) shall not be greater than fifty percent of the total amount of funding available for each eligible project."

After debate, the question being put on the amendment, it was negatived.

Gerald Keddy moved, -- That Bill C-4, in Clause 19, be amended by replacing lines 16 to 25 on page 11 with the following:

19. Benoit Serré moved, - That the amendment be amended by deleting the words "At the annual meeting in each fiscal year," and inserting the words "At the first meeting of the members, and in any subsequent fiscal year at the annual meeting."

The amendment to the amendment was agreed to.

On Clause 29,

Benoit Serré moved, -- That Bill C-4, in Clause 29, be amended by

After debate, John Finlay moved, - That the amendment be further amended by replacing the word "will" with the following:

"may".

Gerald Keddy moved, -- That Bill C-4, in Clause 32, be amended by replacing lines 36 to 47 on page 17 and lines 1 to 3 on page 18 with the following:

On new Clause ( 33.1 )

Serge Cardin moved, -- That Bill C-4 be amended by adding after line 6 on page 18 the following new clause:

"33.1 For the purposes of the Access to Information Act, the Foundation is deemed to be a government institution within the meaning of section 3 of that Act."
