Meeting No. 54
Monday, May 8, 2000
The Standing Committee on Transport met at 3:38 p.m. this day, in Room 269, West Block, the Chair, Stan Keyes, presiding.
Members of the Committee present: Roy Bailey, Murray Calder, Bill Casey, Stan Dromisky, Claude Drouin, Joe Fontana, Michel Guimond, Charles Hubbard, Ovid Jackson, Stan Keyes, Lou Sekora.
In attendance: From Legislative Services: Jacques Lahaie and Richard Dupuis, Legislative Clerks. From the Library of Parliament: John Christopher and June Dewetering, Researchers.
Witnesses: From the Transport Canada: Valérie Dufour, Director General, Air Policy and Programs; Jacques E. Pigeon, General Counsel, Legal Services.
Pursuant to its Order of Reference of Tuesday, February 29, 2000, the Committee resumed consideration of Bill C-26, An Act to amend the Canada Transportation Act, the Competition Act, the Competition Tribunal Act and the Air Canada Public Participation Act and to amend another Act in consequence (See Minutes of Proceedings, Tuesday, April 4, 2000 , Meeting No. 42).
The Committee proceeded to Clause-by-Clause consideration of the Bill.
By unanimous consent, Clauses 1, 5, 9, 10, 11, 12, 14, 16, 20 and 21 severally carried.
By unanimous consent, Clauses 6, 7, 8, 13, 15, 17, 18 and 19 were allowed to stand.
On Clause 2,
Lou Sekora moved, -- That Bill C-26, in Clause 2, be amended by adding after line 14 on page 7 the following:
"(5) Sections 174 and 175 do not apply in respect of an offence committed under subsection (1) or (2)."
After debate, the question being put on the amendment, it was agreed to.
After debate, Clause 2 was allowed to stand.
On Clause 3,
Charles Hubbard moved, -- That Bill C-26, in Clause 3, be amended by replacing line 39 on page 7 with the following:
"until the expiry of 120 days, or 30 days if the service referred to in that subsection has been in operation for less than one year, after the notice is"
After debate, the question being put on the amendment, it was agreed to.
Roy Bailey moved, -- That Bill C-26, in Clause 3, be amended by adding after line 42 on page 7 the following:
"(2.1) Subsection (2) does not apply to a route on which the licensee has been providing air service for a period of less than one year."
By unanimous consent, Mr. Bailey was allowed to withdraw his amendment.
After debate, Clause 3, as amended, carried.
On Clause 4,
Ovid Jackson moved, -- That Bill C-26, in Clause 4, be amended by replacing line 25 on page 9 with the following:
"number of seats available at those fares;
(b.1) the competition from other modes of transportation, if the finding is in respect of a cargo rate, an increase in a cargo rate or a range of cargo rates; and"
After debate, the question being put on the amendment, it was agreed to.
At 5:14 p.m., the sitting was suspended.
At 5:53 p.m., the sitting resumed.
Clause 4, as amended, carried.
By unanimous consent, the Committee reverted to Clause 2, which has been stood.
After debate, Clause 2, as amended, carried on division.
At 6:20 p.m., the Committee adjourned to the call of the Chair.
