Meeting No. 14

Wednesday, February 9, 2000

The Standing Committee on Health met at 3:37 p.m. this day, in Room 371, West Block, the Chair, Lynn Myers, presiding.

Members of the Committee present: Yvon Charbonneau, Ovid Jackson, Keith Martin, Ted McWhinney, Réal Ménard, Lynn Myers, Bernard Patry, Karen Redman, Paul Szabo, Judy Wasylycia-Leis.

Acting Members present: Marcel Proulx for Bernard Patry, Steve Mahoney for Bill Matthews.

In attendance: From the Library of Parliament: Nancy Miller Chenier, Research Officer.

Witnesses: From the Canadian Institutes of Health Research: Pierre Richard, Executive Director, CIHR Transition Secretariat; David Hoye, Director of Policy and Goverment Relations, CIHR Transition Secretariat. From the Medical Research Council of Canada: Karen Mosher, Executive Director. From Justice Canada: Glenn Rivard, General Counsel.

Pursuant to its Order of Reference of Monday, November 29, 1999, the Committee resumed consideration of Bill C-13, An Act to establish the Canadian Institutes of Health Research, to repeal the Medical Research Council Act and to make consequential amendments to other Acts (See Minutes of Proceedings, Thursday, December 2, 1999 , Meeting No. 8).

The Committee resumed clause by clause consideration of the Bill.

On Clause 10,

By unanimous consent, it was agreed, - That Clause 10, previously carried, be reconsidered.

Yvon Charbonneau moved, -- That Bill C-13, in Clause 10, be amended by replacing, in the French version, lines 34 to 37 on page 7 with the following:

Honoraires

" (3) Le gouverneur en conseil peut fixer les honoraires que les membres ne faisant pas partie du conseil d'administration reçoivent pour leurs services."

Debate arose thereon and the witnesses answered questions.

After debate, the question being put on the amendment, it was adopted by unanimous consent.

Clause 10, as amended, carried unanimously.

RULING OF THE CHAIR

I rule that a negative vote on R-11 and / or R-12 obviates the necessity of putting the question on R-10. The Committee must therefore deal with R-11 first, then R-12.

If either or both are defeated, R-10 need not be put.

Keith Martin moved, -- That Bill C-13, in Clause 14, be amended by adding after line 12 on page 9 the following:

"(2) When approving the budget under paragraph 14(1)(c), the Governing Council shall not allocate more than five per cent of the CIHR budget for the year to administrative expenses."

"(3) When approving the budget under paragraph 14(1)(c) for any given year, the Governing Council shall ensure that

(a) no less than 20 per cent of the research portion of the budget is allocated to basic scientific research; and
(b) no less than 20 per cent of the research portion of the budget is allocated to researchers who have no private sector co-funding."

By unanimous consent, it was agreed, - That the Committee reconsider earlier lines in Clause 14.

On Clause 14,

Judy Wasylycia-Leis moved, - That Bill C-13 in Clause 14 be amended by adding immediately after line 3 on page 9, the following:

"14(e)(i) Ensuring that where such funding is in place for the conduct or support of clinical research, that women are included as subjects in each project of such research; and members of minority groups are included as subjects in such research."

Debate arose thereon.

It was agreed, - That the amendment be circulated in one language only.

It was agreed, -- That the amendment be circulated in one language only.

After debate, the question being put on the amendment, it was negatived on the following recorded division:

Judy Wasylycia-Leis moved, -- That Bill C-13, in Clause 20, be amended by replacing lines 33 and 34 on page 10 with the following:

"(4) The Governing Council shall appoint to the Advisory Boards an equal number of women and men who are"

After debate, the question being put on the amendment, it was negatived on the following recorded division:

"(5) The members shall not, directly or indirectly, as owner, shareholder, director, officer, partner or otherwise, have any pecuniary or proprietary interest in any business which operates in the pharmaceutical or medical devices industries."

After debate, the amendment was stood.

Clause 20 was stood.

Clause 21 and 22 were carried by unanimous consent
