Meeting No. 47

Thursday, December 3, 1998

The Standing Committee on Aboriginal Affairs and Northern Development met at 3:45 p.m. this day, in Room 371, West Block, the Vice-Chair, John Finlay, presiding.

Members of the Committee present: Peter Adams, Claude Bachand, John Bryden, John Finlay, Louise Hardy, David Iftody, Nancy Karetak-Lindell, Derrek Konrad, Judi Longfield and Bryon Wilfert.

In attendance: From the Library of Parliament: Mary Hurley and Jill Wherrett, Research Officers. From Committees and Legislative Services: Suzanne Verville, Legislative Clerk.

Witnesses: From the Beaucage Tenants Association: Suzanne M. Leclair, Lawyer; Jerry Kerwin, Member. From the Jocko Point Tenants Association: Rusty Wiley, Vice-President; Jeannine Morin, Policy Director. From the Assembly of First Nations: Brenda Miller, Chief of Staff. The Committee resumed consideration of Bill C-49, An Act providing for the ratification and the bringing into effect of the Framework Agreement on First Nation Land Management. (See Minutes of Proceedings dated Thursday, December 3, 1998, Meeting No. 46)

Suzanne Leclair and Jerry Kerwin, from Beaucage Tenants Association, and Jeannine Morin and Rusty Wiley, from Jocko Point Tenants Association, made statements and answered questions.

Brenda Miller, from the Assembly of First Nations, read a letter from National Chief Phil Fontaine into the record.

Chief Bill Williams, from the Interim Lands Advisory Board, Harold Calla, from Squamish First Nation, Chief Harry Donaghey, from N'Quatqua First Nation, Chief Darlene Yellow Old Woman Munro and Jack Royal from Siksika First Nation, made statements and answered questions.

Chief Rennie Goose, from Scugog Island First Nation and Chief Bill McCue, from Georgina Island First Nation, made statements and answered questions.

Robert Louie, Chairman of the Interim Lands Advisory Board made a closing statement.

At 5:45 p.m., the sitting was suspended.

At 6:10 p.m., the sitting resumed.

The Committee proceeded to Clause-by-Clause consideration of the Bill.

On Clause 2.

Derrek Konrad moved, -That Bill C-49, in Clause 2, be amended by adding after line 33 on page 2 the following:

Under Not land claims agreement

"(3) For greater certainty, neither the Framework Agreement nor this Act is a land claims agreement referred to in section 35 of the Constitution Act, 1982.

After debate, the question being put on the amendment, it was agreed to.

Clause 2, as amended, carried.

Clause 3 to 48 carried severally.

The Schedule carried.

Clause 1 carried.

The Preamble carried.

The Title carried.

The Bill, as amended, carried

ORDERED, -That the Chairman report the Bill, as amended, to the House.

At 6:20 p.m., the Committee adjourned to the call of the Chair.
