Meeting No. 17

TUESDAY, DECEMBER 9, 1997-12-19

The Standing Committee on Aboriginal Affairs and Northern Development met at 3:38 o'clock p.m., this day, in room 705 La Promenade Building, the Chair, Guy Saint-Julien, presiding.

Members of the Committee present: John Bryden, John Finlay, Ghislain Fournier, David Iftody, Nancy Karetak-Lindell, Gerald Keddy, Derrek Konrad, Judi Longfield, Grant McNally, Bernard Patry, Guy Saint-Julien, Mike Scott and Bryon Wilfert.

In attendance: From the Research Branch of the Library of Parliament: Mary C. Hurley and Jill Wherret, Research Officers. From the Committees and Legislative Services Directorate: Charles Bellemare, Legislative Clerk.

The Committee resumed consideration of Bill C-6, An Act to provide for an integrated system of land and water management in the Mackenzie Valley, to establish certain boards for that purpose and to make consequential amendments to other Acts. (See Minutes of Proceedings dated Tuesday, November 18, 1997, Meeting No. 6)

The Committee resumed consideration of Clause 2.

Bernard Patry moved, -- That Bill C-6 in clause 2, be amended by replacing, in the French version, lines 18 to 24 on page 4 with the following:

"soixantième parallèle, à l'est de la limite du Yukon, au sud de la limite de la région inuvialuit désignée -- au sends de l'accord m is en vigueur par la Loi sur le règlement des revendications des Inuvialuit de la région ouest de l'Arctique -- et à l'ouest de la limite de la région du Nunavut, au sens"

After debate the question being put on the amendment, it was agreed to on division.

By unanimous consent, Clause 2 as amended was allowed to stand.

Clauses 3 to 7 carried severally.

On Clause 8

Bernard Patry, moved, -- That Bill C-6, in Clause 8, be amended by

  1. replacing lines 32 and 33 on page 5 with the following:

"8. (1) The federal Minister shall consult the first nations with respect"

(b) adding after line 34 on page 5 the following:

"(2) The federal Minister shall, in the course of any negotiations with a first nation relating to self-government, review the pertinent provisions of this Act in consultation with the first nation".

After debate, the question being put on the amendment, it was agreed to.

Clause 8, as amended, carried.

Clause 9 carried.

New Clause 9.1

Bernard Patry moved, -- That Bill C-6 be amended by adding after line 2 on page 6 the following:

"9.1 The purpose of the establishment of boards by this Act is to enable residents of the Mackenzie Valley to participate in the management of its resources for the benefit of the residents and of other Canadians."

After debate, the question being put on the amendment, it was agreed to.

Clause 10 carried.

On Clause 11

Derek Konrad moved, -- That Bill C-6, in Clause 11, be amended by

(a) replacing lines 8 to 12 on page 6 with the following:

"appointed under section 15, shall, in the case of those members who are, pursuant to Parts 2 to 5, to be nominated by a first nation or a territorial Minister or following consultation with first nations, be appointed by the federal Minister in accordance with those provisions, and in every other case shall be elected as provided in subsections (3) to (5)."

(c) by adding after line 24 on page 6 the following:

(3) The members of a board who are to be elected pursuant to subsection (1) shall be elected by electors of all or a part of one or more electoral districts established pursuant to any Act governing the election of members of Parliament, members of the legislative assembly of a province or members of a local authority in a province, as determined by the federal Minister.

(4) The federal Minister may for the purpose of elections under this section make regulations

(a) providing for

(i) electors under all or part of one or more electoral districts as defined in the Canada Elections Act, or

(ii)electors under all or part of one or more areas entitled to elect, under the laws of the province concerned, members of the legislative assembly or a local authority, to elect the member;

(b) providing for the application of all or a part of any Act of Parliament or of the legislature eof a province to apply to the election; and

(e) providing for the election to be held independently or in conjunction with a general election or by-election.

(5) The federal Minister may enter into agreements with one or more provinces to provide for the carrying out of an election of a member of a board2

After debate, the question being put on the amendment, it was negatived.

Clause 11 carried.

Clauses 12 and 13 carried severally.

Clause 14 carried on division.

Clauses 15 to 21 carried severally.

New Clause 21.1

Derrek Konrad moved, -- That Bill C-6 be amended by adding after line 44 on page 8 the following:

"21.1 The boards shall prepare minutes of every meeting and shall make them available for public consultation."

After debate, by unanimous consent, it was agreed, - That consideration of the amendment under debate and the proposed amendment of Derrek Konrad to insert another new clause 21.1 into the Bill be deferred until consideration of Clause 20 had been completed.

Clauses 22 to 28 carried severally.

On Clause 29

Bernard Patry moved, -- That Bill C-6, in Clause 29, be amended by replacing line 26 on page 10 with the following:

"administrative affairs, including by-laws providing for the maintenance at its office of the minutes of its meetings."

After debate, the question being put on the motion, the result of the recorded division was announced as follows:
