Group No. 2 Motion No. 5 of Mr. Ramsay (Crowfoot), seconded by Mr. Hermanson (Kindersley -- Lloydminster), -- That Bill C-41, in Clause 6, be amended by deleting lines 21 to 39, on page 8, and lines 1 to 15, on page 9. Motion No. 6 of Ms. Skoke (Central Nova), seconded by Mr. McTeague (Ontario), -- That Bill C-41, in Clause 6, be amended by replacing lines 28 to 39, on page 8, with the following: ``limiting the generality of the foregoing, evidence that the offender, in committing the offence, abused a position of trust or authority in relation to the victim shall be deemed to be an aggravating circumstance;". Motion No. 7 of Mr. McTeague (Ontario), seconded by Ms. Skoke (Central Nova), -- That Bill C-41, in Clause 6, be amended by replacing lines 30 to 34, on page 8, with the following: ``vated by prejudice, or". Motion No. 12 of Mr. Wappel (Scarborough West), seconded by Mr. McTeague (Ontario), -- That Bill C-41, in Clause 6, be amended (a) by replacing lines 33 and 34, on page 8, with the following: ``or physical disability, sexuality of the victim, or"; and (b) by adding after line 15, at page 9, the following: ``(2) For the purposes of this section, ``sexuality" means, only, heterosexuality, homosexuality, or bisexuality and, for greater certainty, does not include a preference towards any sexual act or activity that would constitute an offence under this Act." Motion No. 13 of Ms. Skoke (Central Nova), seconded by Mr. McTeague (Ontario), -- That Bill C-41, in Clause 6, be amended by replacing line 33, on page 8, with the following: ``or physical disability". Motion No. 14 of Mr. Wappel (Scarborough West), seconded by Mr. McTeague (Ontario), -- That Bill C-41, in Clause 6, be amended in the English version, by replacing line 33, on page 8, with the following: ``or physical disability, sexual orientation,". Motion No. 15 of Mrs. Venne (Saint-Hubert), seconded by Mr. St-Laurent (Manicouagan), -- That Bill C-41, in Clause 6, be amended by replacing line 34, on page 8, with following: ``or any other similar factor, (i.1) evidence that the offender, in committing the offence, committed an assault within the meaning of section 265 against the offender's spouse, common-law spouse or former spouse, whether or not the assault caused bodily harm, or''. Motion No. 16 of Mr. Szabo (Mississauga South), seconded by Ms. Skoke (Central Nova), -- That Bill C-41, in Clause 6, be amended by adding after line 34, on page 8, the following: ``(i.1) evidence that the offender committed an indictable offence that consisted of a physical or sexual assault on or harm to the person of the offender's spouse or common law spouse or an attempt or threat to carry out such an offence; or''. Motion No. 17 of Mr. Rock (Minister of Justice), seconded by Mr. Milliken (Parliamentary Secretary to the Leader of the Government in the House of Commons), -- That Bill C-41, in Clause 6, be amended by striking out line 36, on page 8 and substituting the following: ``mitting the offence, abused his or her spouse or child or abused a position of". The debate continued on the motions in Group No. 2. Mr. Keyes (Hamilton West), seconded by Mr. Szabo (Mississauga South), moved the following amendment to Motion No. 17, -- That Motion No. 17 be amended by striking out all of the words after ``mitting the offence" and substituting the following therefor: ``abused the offender's spouse or child, or, (iii) evidence that the offender, in committing the offence, abused a position of". The debate continued on the motions in Group No. 2. At 5:12 p.m., pursuant to Order made Thursday, June 8, 1995, under the provisions of Standing Order 78(2), the Speaker interrupted the proceedings. The question was put on Motion No. 5 and, pursuant to Standing Order 76.1(8), the recorded division was deferred. Group No. 3 Mrs. Venne (Saint-Hubert), seconded by Mr. St-Laurent (Manicouagan), moved Motion No. 18, -- That Bill C-41, in Clause 6, be amended by replacing line 39, on page 16, with the following: ``amined that substance and stating the result of". Group No. 4 Mr. Rock (Minister of Justice), seconded by Mr. Gagliano (Secretary of State (Parliamentary Affairs) and Deputy Leader of the Government in the House of Commons), moved Motion No. 19, -- That Bill C-41, in Clause 6, be amended (a) by striking out line 4, on page 26, and substituting the following: ``prison, calculated in accordance with regulations made under subsection (7), and"; (b) by adding immediately after line 21, on page 26, the following: ``(7) The Lieutenant Governor in Council of a province may make regulations respecting the calculation of the costs and charges referred to in Clause (5)(a)(i)(b) and in paragraph 734.8(1)(b)."; and (c) by striking out line 5, on page 30, and substituting the following: ``conveying the defaulter to prison, calculated in accordance with regulations made under subsection 734(7)." Mr. Gray (Leader of the Government in the House of Commons and Solicitor General of Canada), seconded by Mr. Goodale (Minister of Agriculture and Agri-Food), moved, -- That a Message be sent to the Senate to acquaint Their Honours that this House agrees to amendment number 4(a) made by the Senate to Bill C-69, An Act to provide for the establishment of electoral boundary commissions and the readjustment of electoral boundaries, and this House disagrees with amendments numbers 1, 2, 3, 4(b), 4(c), 5, 6 and 7 for the following reasons: The bill was, in accordance with the new procedures of this House, prepared by a Committee of the House. While amendment number 4 (a) corrects an omission, the other amendments address points, each of which were supported by Members representing at least two of the three parties officially recognized in the House. Taken together, the bill represents a balance aimed at improving the responsiveness of the system of readjusting electoral boundaries both to rapid shifts of population and to the operative realities of effective representation of the people, a balance that, in the opinion of this House, requires: (a) in view of the varied Canadian geography and demography, the retention of a variation of up to 25% from the electoral quota of each province (addressed by amendments numbers 1 and 6(a)); (b) the avoidance of unnecessary electoral boundary adjustments in provinces where shifts of population do not require them (addressed in amendments numbers 2, 3, 5, 6(b)(i) and 7); (c) the clear acceptance of the non-partisan status of members of commissions through the provision of parliamentary oversight of appointments (addressed by amendments numbers 4(b) and 4(c)); (d) the retention of the definition of ``community of interest" developed on a non-partisan basis by currently serving elected representatives, through a consensus of all parties, in the House of Commons Standing Committee rather than the substitution of another definition (addressed by amendment number 6(b)(ii)). Debate arose thereon.
