Pursuant to the order of reference of Monday, April 24, 2023, the committee resumed consideration of Bill C-27, An Act to enact the Consumer Privacy Protection Act, the Personal Information and Data Protection Tribunal Act and the Artificial Intelligence and Data Act and to make consequential and related amendments to other Acts.

The witnesses answered questions.

The committee resumed its clause-by-clause study of the Bill.

The committee resumed clause-by-clause consideration on Clause 2 of the Bill.

The committee resumed consideration of the amendment of Brad Vis, — That Bill C-27, in Clause 2, be amended by adding after line 25 on page 5 the following:

minor means an individual under 18 years of age. (mineur)”

Bernard Généreux moved, — That Bill C-27, in Clause 2, be amended by adding after line 31 on page 5 the following:

profiling means any form of automated processing of personal information consisting of the use of personal information to evaluate certain personal aspects relating to an individual, in particular to analyze or predict aspects concerning that individual's performance at work, economic situation, health, reliability, behaviour, location or movements. (profilage)”

By unanimous consent, after debate, the question was put on the amendment of Bernard Généreux and it was agreed to.

Brad Vis moved, — That Bill C-27, in Clause 2, be amended by adding after line 33 on page 5 the following:

sensitive, in relation to information, includes any information pertaining to an individual that reveals

(a) their racial or ethnic origin;

(b) their political opinions, religious or philosophical beliefs, trade union or political membership, or political contribution history;

(c) their sexual orientation or sexual habits;

(d) genetic data or biometric data that can uniquely identify them;

(e) their health condition, including any treatment or prescription on their medical record;

(f) government identifiers, such as their social security, passport or driver's license numbers;

(g) the content of their electronic devices, including messages, images, address books, calendars and call history;

(h) their passwords; or

(i) financial data. (de nature sensible)”

Debate arose thereon.

Simon-Pierre Savard-Tremblay moved, — That the amendment be amended by adding after subparagraph “(i)” the following: “(j) any other information violating the fundamental right to privacy.”.

After debate, by unanimous consent, the subamendment was withdrawn.

Simon-Pierre Savard-Tremblay moved, — That the amendment be amended by adding after subparagraph “(i)” the following: “(j) personal information in respect of which, due to the context of its use or disclosure, an individual has a high reasonable expectation of privacy.”.

Debate arose thereon.

Motion

By unanimous consent, Ryan Williams moved, — That in regard to the government’s EV Battery Plant subsidies the Committee invite the CEOs of Stellantis N.V., LG Energy Solutions, Ltd., NextStar Energy Inc. and the Minister of Innovation Science and Economic Development Canada to answer questions no later than Friday, May 17, 2024.

Brian Masse moved, — That the motion be amended by adding after the words “Minister of Innovation Science and Economic Developement Canada” the following: “Victor Fedeli, Minister of Economic Development, Job Creation and Trade of Ontario”.
