The Standing Committee on National Defence met at 3:31 p.m. this day, in Room 362, East Block, the Chair, Rick Casson, presiding.

 

Members of the Committee present: Claude Bachand, Dawn Black, Steven Blaney, Rick Casson, Cheryl Gallant, Laurie Hawn, James Lunney, Hon. Joe McGuire, Anthony Rota and Hon. Bryon Wilfert.

 

Acting Members present: Joe Comartin for Dawn Black, Jacques Gourde for Steven Blaney, Brian Murphy for John Cannis, Jean-Yves Roy for Robert Bouchard, Ève-Mary Thaï Thi Lac for Robert Bouchard, Alan Tonks for John Cannis, Alan Tonks for Hon. Joe McGuire, Jeff Watson for James Lunney and John Williams for Laurie Hawn.

Pursuant to the Order of Reference of Monday, June 16, 2008, the Committee commenced consideration of Bill C-60, An Act to amend the National Defence Act (court martial) and to make a consequential amendment to another Act.
 

BGen Kenneth W. Watkin made a statement and answered questions.

 

At 4:30 p.m., the sitting was suspended.

At 4:35 p.m., the sitting resumed.

 

Michel Drapeau made a statement and answered questions.

 

At 5:28 p.m., the sitting was suspended.

At 6:15 p.m., the sitting resumed.

 
The Committee commenced its clause-by-clause study of the Bill.
 

The Chair called Clause 1.

 

Clause 1 carried.

 

Clause 2 carried.

 

By unanimous consent, Clauses 3 to 12 inclusive carried.

 

Clause 13 carried.

 

By unanimous consent, Clauses 14 to 26 inclusive carried.

 

Clause 27 carried.

 

On Clause 27.1,

Bryon Wilfert moved, — That Bill C-60 be amended by adding after line 31 on page 8 the following new clause:

“REVIEW AND REPORT

27.1 (1) Within two years after the day on which this Act receives royal assent, a comprehensive review of the provisions and operation of this Act shall be undertaken by the committee of either the Senate or the House of Commons or of both Houses of Parliament that is designated or established by the Senate or the House of Commons or by both Houses of Parliament, as the case may be, for that purpose.

(2) Within one year after the review is undertaken, or within any longer period that the Senate or the House of Commons or both Houses of Parliament may authorize, the committee shall submit a report on the review to Parliament, including a statement of any changes that the committee recommends.”

 

Claude Bachand moved, — That the amendment be amended by replacing the words “the committee of either the Senate or the House of Commons or of both Houses of Parliament that is designated or established by the Senate or the House of Commons or by both Houses of Parliament, as the case may be, for that purpose.” by the following:

“by a committee that is designated by the House of Commons for that purpose.”

and by replacing the words “(2) Within one year after the review is undertaken, or within any longer period that the Senate or the House of Commons or both Houses of Parliament may authorize, the committee shall submit a report on the review to Parliament, including a statement of any changes that the committee recommends.” by the following:

“(2) Within one year after the review is undertaken, or within any longer period that the House of Commons may authorize, the committee shall submit a report on the review, including a statement of any changes that the committee recommends, to the House of Commons.”

 

The question was put on the subamendment of Claude Bachand and it was negatived.

 

After debate, the question was put on the amendment of Bryon Wilfert and it was agreed to.

 

After debate, Clause 28 was negatived.

 

Clause 29 carried.

 

Clause 30 carried.

 

Clause 31 carried.

 

On new Clause 31.1,

Claude Bachand moved, — That Bill C-60 be amended by adding after line 39 on page 10 the following new clause:

“SUNSET PROVISION

31.1 The amendments made by this Act cease to have effect on the day that is two years after the day on which this Act comes into force or, if Parliament is not then in session, on the day that is 90 days after the commencement of the next ensuing session.”

 

Dawn Black moved, — That the amendment be amended by replacing the words “two years” with the words “three years”

 

The question was put on the subamendment of Dawn Black and it was negatived.

 

The question was put on the amendment of Claude Bachand and it was negatived.

 

Clause 32 carried.

 

The Title carried.

 

The Bill, as amended, carried on division.

 

ORDERED, — That the Chair report the Bill, as amended, to the House.

 

ORDERED, — That Bill C-60, as amended, be reprinted for the use of the House at report stage.
