The Standing Committee on Justice and Human Rights met at 3:31 p.m. this day, in Room 306, La Promenade Building, the Chair, Mike Wallace, presiding.

 

Members of the Committee present: Dan Albas, Françoise Boivin, Hon. Irwin Cotler, Robert Goguen, Pierre Jacob, Hoang Mai, Kyle Seeback, Mike Wallace and David Wilks.

 

Acting Members present: Joe Daniel for Scott Armstrong, Richard M. Harris for Brent Rathgeber, Kellie Leitch for Scott Armstrong, Dany Morin for Wayne Marston and Francine Raynault for Pierre Jacob.

 

In attendance: Library of Parliament: Cynthia Kirkby, Analyst; Dominique Valiquet, Analyst.

Pursuant to the Order of Reference of Wednesday, June 6, 2012, the Committee resumed consideration of Bill C-273, An Act to amend the Criminal Code (cyberbullying).
 

Peter Jon Mitchell, Paul Taillefer and Bill Belsey, by videoconference from Cochrane, Alberta, made statements and answered questions.

 

At 4:32 p.m., the sitting was suspended.

At 4:34 p.m., the sitting resumed.

 

Robert Goguen moved, — That the Committee, pursuant to Standing Order 97.1, recommend that the House of Commons do not proceed further with Bill C-273, An Act to amend the Criminal Code (cyberbullying), because:

Bill C-273 raises criminal policy and drafting concerns;

Parliamentary review of the bullying issue is still on-going and legislation to address this matter is pre-mature;

The overwhelming majority of witnesses appearing before the Committee have raised concerns with this legislation; and

That the Chair present the report to the House.

Debate arose thereon.

 

Françoise Boivin moved, — That the motion be amended by deleting the words “Parliamentary review of the bullying issue is still on-going and legislation to address this matter is premature;”.

 

The question was put on the amendment of Françoise Boivin and it was agreed to, by a show of hands: YEAS: 10; NAYS: 1.

 

The question was put on the motion, as amended, and it was agreed to, by a show of hands: YEAS: 10; NAYS: 1.

 

The motion, as adopted, read as follows:

That the Committee, pursuant to Standing Order 97.1, recommend that the House do not proceed further with Bill C-273, An Act to amend the Criminal Code (cyberbullying), because:

Bill C-273 raises criminal policy and drafting concerns;

The overwhelming majority of witnesses appearing before the Committee have raised concerns with this legislation; and

That the Chair present the report to the House.

 

It was agreed, — That a proposed budget in the amount of $2,800, for the study of Bill C-273, An Act to amend the Criminal Code (cyberbullying), be adopted.

 

At 5:14 p.m., the Committee adjourned to the call of the Chair.
