A point of order was raised by Serge Cardin asking that the Committee reconsider its decision taken on February 24, 2009 to complete the clause-by-clause study of Bill C-2 on March 3, 2009, due to the fact that certain members were not allowed to fully participate in the debate on that motion before the vote.
RULING OF THE CHAIR
The Chair ruled that a decision once made cannot be questioned again but must stand as the judgement of the Committee, as provided on page 495 of House of Commons Procedure and Practice.
Whereupon, Peter Julian appealed the decision of the Chair.
The question: “Shall the decision of the Chair be sustained?” was put and the decision was sustained by a show of hands: YEAS: 8; NAYS: 3.
A point of order was raised by Peter Julian asking for a second vote on his appeal of the Chair’s decision, this time by a recorded division.
RULING OF THE CHAIR
The Chair ruled that the result of the vote by a show of hands was final and that the request for a recorded division should have been made when the vote was first taken.
Whereupon, Peter Julian appealed the decision of the Chair.
The question: “Shall the decision of the Chair be sustained?” was put and the decision was overturned by a show of hands: YEAS: 5; NAYS: 6.
