The Standing Committee on Government Operations and Estimates met at 9:20 a.m. this day, in Room 362, East Block, the Chair, Reg Alcock, presiding.

Members of the Committee present: Reg Alcock, Roy Cullen, Raymonde Folco, Paul Forseth, Paul Szabo and Tony Tirabassi.

Pursuant to its Order of Reference of Thursday, February 20, 2003, the Committee resumed consideration of Bill C-25, An Act to modernize employment and labour relations in the public service and to amend the Financial Administration Act and the Canadian Centre for Management Development Act and to make consequential amendments to other Acts (See Minutes of Proceedings, Thursday, February 27, 2003, Meeting No. 12).

The Committee resumed to Clause-by-Clause consideration of the Bill.


That the Committee overturn their decision to reopen Clause 19 of Bill C-25 because of the absence of unanimous consent. In other words, return to the point at which Clause 19 was passed without amendment.

By unanimous consent, the Committee reverted to Clause 184.

Clause 184 carried on division.

By unanimous consent, the Committee reverted to Clause 12.

Roy Cullen moved, -- That Bill C-25, in Clause 12, be amended by replacing lines 31 to 39, page 117 with the following:

6.(3) If the President is absent or unable to act or if the office of the President is vacant for a period not exceeding sixty days, the President chooses, amongst the Commissioners, who will act as President. If the President is unable to make such a choice, the Commissioners will choose, amongst themselves, who will act as President.

6.(4) If the President is absent or unable to act or if the office of the President is vacant for a period exceeding the period mentioned in subsection (3), the Governor in Council may authorize a Commissioner or the other qualified person to act as President.

Pierre Paquette moved the following sub-amendment, -- That the amendment be amended in the English version, by replacing “may” with “shall”.

The question was put on the sub-amendment, it was agreed to.

Paul Szabo moved, -- That Bill C-25, in Clause 12, be amended by replacing lines 35 and 36, on page 152 with the following:
