MINUTES OF PROCEEDINGS

Meeting No. 5

Tuesday, November 2, 1999

The Standing Committee on Fisheries and Oceans met at 9:07 a.m. this day, in Room 701, La Promenade Building, the Chair, Wayne Easter, presiding.

Member(s) of the Committee present: Sarkis Assadourian, Yvan Bernier, John Cummins, Claude Drouin, John Duncan, Wayne Easter, Bill Gilmour, Nancy Karetak-Lindell, Bill Matthews, Lawrence O'Brien, Charlie Power, Carmen Provenzano, Paul Steckle, Peter Stoffer.

In attendance: From the Research Branch of the Library of Parliament: Alan Nixon, Research Officer.

Witness(es): From the Atlantic Fishing Industry Alliance: Jim Fraelic, President, South Shore Gill Net Association; Denny Morrow, Coordinator; Don Cunningham, Vice-President; Melanie Sonnenberg, President. From the Bay of Fundy Inshore Fishermen's Association: Arthur Bull, Coordinator; Harold Theriault, President; Ashton Spinney.

Pursuant to Standing Order 108(2), study on the implications of the September 17th, 1999 Supreme Court decision on R. v. Marshall on the Management of fisheries in the Atlantic Region.

By videoconference from Halifax.

Denny Morrow made an opening statement and, with the other witnesses, answered questions.

Arthur Bull made an opening statement and, with the other witnesses, answered questions.

The Chairman presented the First Report of the Sub-Committee on Agenda and Procedure which is as follow:

  • That Carmen Provenzano chair the Sub-Committee to plan the activities related to the studies of the Oceans Act and Aquaculture and that the sub-committee membership be Carmen Provenzano, Charlie Power, Bill Gilmour, Yvan Bernie and others to be named at a later date.
  • That the Committee undertake the study of the following items:

- October to December 1999 R. v. Marshall Decision

- February and March 2000 Aboriginal Fishing Strategy and Aquaculture issues

- April to June 2000 Review of the Oceans Act and continuing study on Aquaculture.

- That the Committee report on the R. v. Marshall decision before Christmas and that the Committee report on the review of the Oceans Act before the summer recess.

On motion of Sarkis Assadourian, it was agreed, - That the First Report of the Sub-Committee on Agenda and Procedure was concurred in.

Yvan Bernier moved, - That the motion adopted by the Committee regarding questioning of witnesses on October 20, 1999 be recinded and the following substituted therefor:

  • That witnesses be given ten (10) minutes for their opening statement and, that during the questioning of witnesses, there be allocated five (5) minutes for the first questioner of each party beginning with the official opposition, followed by the Bloc québécois, the New Democratic Party, the Progressive Conservative Party and the Liberal Party and that thereafter five (5) minutes be allocated to each subsequent questioner, alternating between opposition and government parties, at the discretion of the Chair.

After debate the question being put on the motion, it was negatived.

On motion of Peter Stoffer, it was agreed to invite the following witnesses to be heard: Hubert Saulnier, the New Brunswick Aboriginal Peoples Council, the Native Council of Nova Scotia, The Native Council of Prince Edward Island, the Conservative Council of New Brunswick and Professor David Bell, University of New Brunswick.

At 11:25 a.m., the Committee adjourned to the call of the Chair.
