Motion No. 9 of Mr. Johnston (Wetaskiwin), seconded by Mr. Gilmour (Nanaimo -- Alberni), -- That Bill C-19, in Clause 24, be amended by replacing lines 32 to 45 on page 19 and lines 1 to 4 on page 20 with the following:

      "47.3 (1) In this section, "previous contractor" means an employer who, under the terms of a contract or other arrangement that is no longer in force, provided pre- board security screening services to another employer, or to a person acting on behalf of that other employer, in an industry referred to in paragraph (e) of the definition "federal work, undertaking or business" in section 2."

Mr. Rocheleau (Trois-Rivières), seconded by Mr. Lebel (Chambly), moved Motion No. 10, -- That Bill C-19, in Clause 31, be amended by replacing lines 19 to 21 on page 23 with the following:

      "(3) The Minister may take only one action referred to in this section with respect to any particular dispute involving a bargaining unit and, in the case of one of the actions referred to in paragraphs (1)(a), (b) or (c), the Minister may take the action only with the consent of the parties."

      "87.2 Unless the parties agree otherwise in writing,
      (2)a notice shall not be required to be given by the trade union to the employer indicating the date on which a strike will occur; and
      (b) a notice shall not be required to be given by the employer to the trade union indicating the date on which a lockout will occur."

Mr. Rocheleau (Trois-Rivières), seconded by Mr. Lebel (Chambly), moved Motion No. 12, -- That Bill C-19, in Clause 37, be amended by replacing lines 17 to 19 on page 27 with the following:

    "seventy-two hours shall not be required to be given by the trade union or the employer if they wish to initiate a strike or lockout."

Mr. Rocheleau (Trois-Rivières), seconded by Mr. Lebel (Chambly), moved Motion No. 13, -- That Bill C-19, in Clause 37, be amended by deleting lines 20 to 38 on page 27 and lines 1 to 31 on page 28.

Mr. Rocheleau (Trois-Rivières), seconded by Mr. Lebel (Chambly), moved Motion No. 14, -- That Bill C-19, in Clause 37, be amended by replacing lines 20 to 38 on page 27 with the following:

      "87.3 (1) Unless a lockout not prohibited by this Part has occurred, a trade union may not declare or authorize a strike unless it has held a secret ballot vote among the employees in the unit and received the approval of the majority of the employees who voted.
      (2) Unless a strike not prohibited by this Part has occurred, an employers' organization may not declare or cause a lockout unless it has held a secret ballot vote among the employers who are members of the organization and received the approval of the majority of the employers who voted."

Mr. Rocheleau (Trois-Rivières), seconded by Mr. Lebel (Chambly), moved Motion No. 15, -- That Bill C-19, in Clause 37, be amended by deleting lines 1 to 6 on page 28.

      "(1.1) During a strike or lockout not prohibited by this Part, no employer or person acting on behalf of an employer shall use the services of a person who was not an employee in the bargaining unit on the date on which notice to bargain collectively was given and was hired or assigned after that date to perform all or part of the duties of an employee in the bargaining unit on strike or locked out if the employees of the bargaining unit continue the activities referred to in subsection (1) in the manner prescribed by that subsection."

Mr. Johnston (Wetaskiwin), seconded by Mr. Anders (Calgary West), moved Motion No. 25, -- That Bill C-19, in Clause 42, be amended by deleting lines 28 to 38 on page 33.

Mr. Rocheleau (Trois-Rivières), seconded by Mr. Ménard (Hochelaga -- Maisonneuve), moved Motion No. 26, -- That Bill C-19, in Clause 42, be amended by replacing lines 28 to 38 on page 33 with the following:

      "(2.1) No employer or person acting on behalf of an employer shall use the services of a person who was not an employee in the bargaining unit on the date on which notice to bargain collectively was given and was hired or assigned after that date to perform all or part of the duties of an employee in the bargaining unit on strike or locked out."

Mr. Dubé (Madawaska -- Restigouche), seconded by Mr. Power (St. John's West), moved Motion No. 27, -- That Bill C-19, in Clause 42, be amended by adding after line 38 on page 33 the following:

      "(2.2) For greater certainty, an employer shall be deemed not to have undermined a trade union's representational capacity by reason only of the employer's use of the services of a person referred to in subsection (2.1)."

Mr. Johnston (Wetaskiwin), seconded by Mr. Anders (Calgary West), moved Motion No. 29, -- That Bill C-19, in Clause 45, be amended by deleting lines 15 to 24 on page 36.

      (b) the person fails to appear as requested by law in relation to the charge whereupon analysis shall be completed and, subject to section 9 of the DNA Identification Act, the results entered into the offender index.
      (6) The Governor in Council shall make regulations respecting the retention of samples taken pursuant to subsection (4)."
