THIRD REPORT

TROISIÈME RAPPORT

In accordance with its Order of Reference of Tuesday, October 20, 1998, your Committee has considered Bill C-42, An Act to amend the Tobacco Act, and agreed on Tuesday, November 3, 1998, to report it with the following amendments:

Conformément à son Ordre de renvoi du mardi 20 octobre 1998, votre Comité a étudié le projet de loi C-42, Loi modifiant la Loi sur le tabac, et a convenu, le mardi 3 novembre 1998, d'en faire rapport avec les amendements suivants :

Clause 1

Article 1

That Bill C-42, in Clause 1, be amended by:

Que le projet de loi C-42, à l'article 1, soit modifié :

(a) replacing line 4 on page 1 with the following:

a) par substitution, à la ligne 4, page 1, de ce qui suit :

"1. Section 24 of the Tobacco Act is"

« 1. L'article 24 de la Loi sur le tabac est »

(b) deleting lines 12 to 14 on page 1

b) par suppression des lignes 12 à 14, page 1.

Clause 2

Article 2

That Bill C-42, in Clause 2, be amended by replacing lines 24 to 35 on page 1 with the following:

Que le projet de loi C-42, à l'article 2, soit modifié :
 

a) par suppression des lignes 24 à 26, page 1;
 

b) par substitution, aux lignes 27 à 35, page 1, de ce qui suit :

"(2) Section 25 of the Act, as it read immediately before the coming into force of subsection (1), continues to apply until October 1, 2003 in relation to the display, on a permanent facility, of a tobacco product-related brand element that appeared on the facility on the day on which this Act comes into force."

« (2) L'article 25 de la même loi, dans sa version antérieure à l'entrée en vigueur du paragraphe (1), s'applique jusqu'au 1er octobre 2003 quant à l'utilisation d'un élément de marque d'un produit du tabac sur des installations permanentes, s'il y figurait à la date d'entrée en vigueur de la présente loi. »

Clause 3

Article 3

That Bill C-42, in Clause 3, be amended by replacing lines 1 to 5 on page 2 with the following:

Que le projet de loi C-42, à l'article 3, soit modifié par substitution, aux lignes 1 à 5, page 2, de ce qui suit :

"3. Paragraphs 33(c) and (d) of the Act are repealed."

Clause 4

Article 4

That Bill C-42, in Clause 4, be amended by replacing lines 7 to 44 on page 2 and lines 1 to 18 on page 3 with the following:

Que le projet de loi C-42, à l'article 4, soit modifié par substitution, aux lignes 6 à 47, page 2, et aux lignes 1 à 20, page 3, de ce qui suit :

"as subsection 66(1).

(2) Subsection 66(1) of the English version of the Act is replaced by the following:

66. (1) Subsections 24(2) and (3) come into force on October 1, 1998 or on any earlier day that the Governor in Council may fix by order.

(3) Section 66 of the Act is amended by adding the following after subsection (1):

(2) If a tobacco product-related brand element was displayed, at any time between January 25, 1996 and April 25, 1997, in promotional material that was used in the sponsorship of an event or activity that took place in Canada, subsections 24(2) and (3) do not apply until

(a) October 1, 2000 in relation to the display of a tobacco product-related brand element in promotional material that is used in the sponsorship of that event or activity or of a person or entity participating in that event or activity; and

(b) October 1, 2003 in relation to the display referred to in paragraph (a) on the site of the event or activity for the duration of the event or activity or for any other period that may be prescribed.

(3) Subsections 24(2) and (3) apply from October 1, 2000 to October 1, 2003 to prohibit the furnishing to the public, on the site of an event or activity to which paragraph (2)(b) applies, of promotional material that displays a tobacco product-related brand element otherwise than in conformity with subsection 24(2)."

(3) Les paragraphes 24(2) et (3) s'appliquent du 2 octobre 2000 au 30 septembre 2003 pour interdire, sur les lieux d'une manifestation ou d'une activité à laquelle s'applique l'alinéa 2b), la fourniture au public de matériel de promotion sur lequel figure un élément de marque d'un produit du tabac, sauf en conformité avec le paragraphe 24(2). »

Clause 5

Article 5

That Bill C-42, in Clause 5, be amended by replacing lines 19 to 21 on page 3 with the following:

Que le projet de loi C-42, à l'article 5, soit modifié par substitution, aux lignes 21 à 23, page 3, de ce qui suit :

"5. (1) Sections 1 and 3 come into force on October 1, 2003.

« 5. (1) Les articles 1 et 3 entrent en vigueur le 1er octobre 2003.

(2) Subsection 66(2) of the Act, except paragraph (b), as enacted by section 4, is deemed to have come into force on October 1, 1998.

(2) Le paragraphe 66(2) de la même loi, à l'exception de l'alinéa b), édicté par l'article 4, entre en vigueur, ou est réputé être entré en vigueur, le 1er octobre 1998.

(3) Paragraph 66(2)(b) and subsection 66(3) of the Act, as enacted by section 4, come into force on October 1, 2000."

(3) L'alinéa 66(2)b) et le paragraphe (3) de la même loi, édictés par l'article 4, entrent en vigueur le 1er octobre 2000. »

Your Committee has ordered a reprint of Bill C-42, as amended, as a working copy for the use of the House of Commons at the report stage.

Votre Comité a ordonné la réimpression du projet de loi C-42, tel que modifié, pour servir de document de travail à la Chambre des communes à l'étape du rapport.

A copy of the Minutes of Proceedings relating to this Bill (Meetings Nos. 52 and 53 of the 1st Session of the 36th Parliament) is tabled.
