Pursuant to the orders of reference of Saturday, April 11, 2020, and Tuesday, May 26, 2020, the committee resumed its study of the government’s response to the COVID-19 pandemic.

Stephen R. Nagy made a statement and answered questions.

Motion

Kelly Block moved, — That, in the context of its study of the government’s response to the COVID-19 Pandemic and pursuant to Standing Order 108(1)(a), the committee send for the following documents to be provided by the government by Friday, June 26, 2020:

1. All briefing notes, memorandums, emails, and documents related to the final contracts signed by the Public Services and Procurement Canada on behalf of the government with suppliers of personal protective equipment between Sunday, March 1, 2020 and Sunday, May 15, 2020, including briefing notes and memorandums related to each contract;

2. All briefing notes, memorandums, emails, and documents related to the matter of pre-payment for each contract signed by the Public Services and Procurement Canada on behalf of the government with suppliers of personal protective equipment between Sunday, March 1, 2020 and Sunday, May 15, 2020;

3. All briefing notes, memorandums, emails, and documents related to the final contract between the Public Services and Procurement Canada on behalf of the government and Deloitte for services related to the management of logistics and procurement of personal protective equipment for the federal government as a result of the COVID-19 pandemic;

4. All briefing notes, memorandums, emails, and documents related to the final contract between the Public Services and Procurement Canada on behalf of the government and Amazon for services related to Amazon's role in the distribution of personal protective equipment as a result of the COVID-19 pandemic;

5. All briefing notes, memorandums, emails, and documents to/from/between Health Canada, the Public Health Agency of Canada, and the Privy Council Office related to the Wednesday, March 18, 2020 Interim Order by the Minister of Health entitled “Interim Order Respecting the Importation and Sale of Medical Devices for use in Relation to COVID-19”;

6. All briefing notes, memorandums, emails, and documents to/from/between Health Canada, the Public Health Agency of Canada, and the Privy Council Office related to the Monday, March 30, 2020 Interim Order by the Minister of Health entitled “Interim Order Respecting Drugs, Medical Devices and Foods for a Special Dietary Purpose in Relation to COVID-19”;

7. All briefing notes, memorandums, emails, and documents to/from/between Health Canada, the Public Health Agency of Canada, and the Privy Council Office related to the issuance of Medical Device Establishment Licenses (MDELs) between Sunday, March 1, 2020 and Wednesday, May 11, 2020;

8. All briefing notes, memorandums, emails, and documents to/from/between Health Canada, the Public Health Agency of Canada, and the Privy Council Office related to the issuance of Medical Device Licenses (MDLs) between Sunday, March 1, 2020 and Wednesday, May 11, 2020;

9. All briefing notes, memorandums, emails, and documents to/from/between Health Canada, the Public Health Agency of Canada, and the Privy Council Office related to the recall of N95/KN95 masks including documents pertaining to the Wednesday, May 11, 2020 MDEL Bulletin produced by the Medical Devices Compliance Program;

10. All briefing notes, memorandums, emails, and documents to/from/between Health Canada, the Public Health Agency of Canada, and the Privy Council Office related to the results and methodology of the testing of personal protective equipment in Canada, including the qualifications of the person or persons, company or companies, agency or agencies carrying out the testing; and

11. All briefing notes, memorandums, emails, and documents to/from/between Health Canada, the Public Health Agency of Canada, and the Privy Council Office on the preparedness of the National Emergency Strategic Stockpile between Tuesday, January 1, 2019 and Friday, May 1, 2020.

Debate arose thereon.

Amendment

Francis Drouin moved, — That the motion be amended by replacing the words “to be provided by the government by Friday, June 26, 2020” with the following:

“from senior officials, and that matters of Cabinet confidence, national security, commercial sensitivity and matters that could jeopardize Canada’s ability to procure and distribute personal protective equipment and other life-saving medical equipment to provinces and territories be excluded from the request, to be provided by the government by Sunday, August 30, 2020”.

Debate arose thereon.

By unanimous consent, it was moved: — That the motion of Ms. Block and the amendment by Mr. Drouin be withdrawn.

The question was put on the motion and it was agreed to by the following recorded division:
