The Standing Committee on Justice and Human Rights met at 3:31 p.m. this day, in Room 7-52, 131 Queen St., the Chair, Ed Fast, presiding.

 

Members of the Committee present: Joe Comartin, Bob Dechert, Ed Fast, Hon. Marlene Jennings, Derek Lee, Marc Lemay, Serge Ménard, Brian Murphy, Rick Norlock, Daniel Petit, Brent Rathgeber and Stephen Woodworth.

 

In attendance: House of Commons: Simon Larouche, Procedural Clerk. Library of Parliament: Robin MacKay, Analyst. House of Commons: Wayne Cole, Legislative Clerk.

 

Witnesses: Statistics Canada: Julie McAuley, Director, Canadian Centre for Justice Statistics; Mia Dauvergne, Senior Analyst, Policing Services Program, Canadian Centre for Justice Statistics; Craig Grimes, Chief and Advisor, Courts Program, Canadian Centre for Justice Statistics. Canada Border Services Agency: Caroline Xavier, Director General, Corporate Secretariat Directorate; Robert Borland, Counsel. Department of Justice: Paula Clarke, Counsel, Criminal Law Policy Section; Carole Morency, Acting General Counsel, Criminal Law Policy Section.

 
Pursuant to the Order of Reference of Monday, October 25, 2010, the Committee commenced consideration of Bill S-9, An Act to amend the Criminal Code (auto theft and trafficking in property obtained by crime).
 

Pursuant to Standing Order 75(1), consideration of Clause 1 was postponed.

The Chair called Clause 2.

 

Caroline Xavier and Julie McAuley made statements and, with the other witnesses, answered questions.

 

At 4:24 p.m., the sitting was suspended.

At 4:28 p.m., the sitting resumed.

 

The Committee commenced its clause-by-clause study of the Bill.

 

Clause 2 carried.

 

On Clause 3,

Serge Ménard moved, — That Bill S-9, in Clause 3, be amended by replacing lines 8 to 11 on page 2 with the following:

“years; or”

 

After debate, the question was put on the amendment of Serge Ménard and it was negatived, by a show of hands: YEAS: 3; NAYS: 7.

 
Serge Ménard moved, — That Bill S-9, in Clause 3, be amended by deleting lines 14 to 20 on page 2.

 

The question was put on the amendment of Serge Ménard and it was negatived, by a show of hands: YEAS: 3; NAYS: 8.

 

Clause 3 carried on division.

 

On Clause 4,

Derek Lee moved, — That Bill S-9, in Clause 4, be amended by replacing lines 24 to 26 on page 2 with the following:

“who, with intent to impede the identification of a motor vehicle and without lawful excuse, wholly or partially alters, removes or obliterates the vehicle identification number on the motor vehicle.”

 

After debate, the question was put on the amendment of Derek Lee and it was negatived, by a show of hands: YEAS: 1; NAYS: 10.

Marlene Jennings moved, — That Bill S-9, in the short title, be amended by replacing, in the English version, lines 4 and 5 on page 1 with the following:

“This Act may be cited as the Addressing Auto Theft and Property Crime Act

 

After debate, the question was put on the amendment of Marlene Jennings and it was negatived, by a show of hands: YEAS: 5; NAYS: 6.

 
Brian Murphy moved, — That Bill S-9, in the short title, be amended by replacing, in the English version, lines 4 and 5 on page 1 with the following:

“This Act may be cited as Law Aimed Against Auto Theft and Property Crime

 

After debate, the question was put on the amendment of Brian Murphy and it was negatived, by a show of hands: YEAS: 3; NAYS: 7.

 

The Short Title carried on division.

 

The Title carried.

 

The Bill carried on division.
