The Standing Committee on Justice and Human Rights met in a televised session at 3:30 p.m. this day, in Room 237-C, Centre Block, the Chair, Ed Fast, presiding.

 

Members of the Committee present: Joe Comartin, Bob Dechert, Ed Fast, Hon. Marlene Jennings, Derek Lee, Marc Lemay, Serge Ménard, Brian Murphy, Rick Norlock, Daniel Petit, Brent Rathgeber and Stephen Woodworth.

 

In attendance: Library of Parliament: Robin MacKay, Analyst. House of Commons: Mike MacPherson, Legislative Clerk.

 

Witnesses: Canadian Centre for Child Protection: Lianna McDonald, Executive Director; Mary Milner, Assistant to the Executive Director. Department of Justice: Catherine Kane, Director General and Senior General Counsel, Criminal Law Policy Section; Normand Wong, Counsel, Criminal Law Policy Section; Jean-François Noël, Counsel, Criminal Law Policy Section.

 
Pursuant to the Order of Reference of Monday, October 4, 2010, the Committee resumed consideration of Bill C-22, An Act respecting the mandatory reporting of Internet child pornography by persons who provide an Internet service.
 

The Committee commenced its clause-by-clause study of the Bill.

 

Pursuant to Standing Order 75(1), consideration of Clause 1 is postponed.

The Chair called Clause 2.

 

Lianna McDonald made a statement and, with the other witnesses, answered questions.

At 4:27 p.m., the sitting was suspended.

At 4:29 p.m., the sitting resumed.

 
Derek Lee moved, — That Bill C-22, in Clause 2, be amended by replacing, in the English version, line 2 on page 2 with the following:

“net content hosting or electronic mail service.”

Debate arose thereon.

 

By unanimous consent, the amendment was withdrawn.

 
Derek Lee moved, — That Bill C-22, in Clause 2, be amended by replacing, in the English version, lines 1 and 2 on page 2 with the following:

““Internet Service” means a service providing Internet access, Internet content hosting or electronic mail.”

 

After debate, the question was put on the amendment of Derek Lee and it was agreed to.

 

Clause 2, as amended, carried.

 

Clause 3 carried.

 

Clause 4 carried.

 

On Clause 5,

Brian Murphy moved, — That Bill C-22, in Clause 5, be amended by replacing line 33 on page 2 with the following:

“possession or control for 30 days after the day”

Debate arose thereon.

 

By unanimous consent, the amendment was withdrawn.

 

After debate, Clause 5 carried.

 

Clause 6 carried.

 

Clause 7 carried.

 

Clause 8 carried.

 

Clause 9 carried.

 

On Clause 10,

Stephen Woodworth moved, — That Bill C-22, in Clause 10, be amended by replacing line 20 on page 3 with the following:

“with section 3 of this Act in relation to that information.”

 

After debate, the question was put on the amendment of Stephen Woodworth and it was agreed to.

 

Clause 10, as amended, carried.

 

Clause 11 carried.

 

Clause 12 carried.

 

On Clause 13,

Brian Murphy moved, — That Bill C-22, in Clause 13, be amended by deleting lines 19 and 20 on page 4.

Debate arose thereon.

 

By unanimous consent, the amendment was withdrawn.

Clause 14 carried.

 

On Clause 1,

Brian Murphy moved, — That Bill C-22, in the short title, be amended by replacing lines 4 and 5 on page 1 with the following:

“1. This Act may be cited as the Child Pornography Reporting Act.”

 

RULING BY THE CHAIR

The amendment seeks to amend the short title of the bill.

As House of Commons Procedure and Practice (2nd Edition) states on pages 770-771:

“The title may be amended only if the bill has been so altered as to necessitate such an amendment.”

In the opinion of the Chair, there have been no amendments requiring a change to the bill’s title and the amendment is therefore inadmissible.

 

The Short Title was negatived by a show of hands: YEAS: 5; NAYS: 6.

 

The Title carried.

 

The Bill, as amended, carried.

 

ORDERED, — That the Chair report the Bill, as amended, to the House.

 

ORDERED, — That Bill C-22, as amended, be reprinted for the use of the House at report stage.
