The Standing Committee on Fisheries and Oceans met at 11:07 a.m. this day, in Room 268, The Valour Building, the Chair, Rodney Weston, presiding.

 

Members of the Committee present: Ryan Cleary, Patricia Davidson, Randy Kamp, François Lapointe, Ryan Leef, Hon. Lawrence MacAulay, Robert Sopuck, John Weston and Rodney Weston.

 

Acting Members present: Yvon Godin for Robert Chisholm.

 

In attendance: Library of Parliament: Thai Nguyen, Analyst. House of Commons: Justin Vaive, Legislative Clerk.

 

Witnesses: Department of Fisheries and Oceans: Angela Bexten, Assistant Director, Global and Northern Affairs, External Relations.

 
The Committee proceeded to the consideration of matters related to Committee business.
 

On motion of John Weston, it was agreed, — That the proposed operational budget in the amount of $36,300, in relation to its study on Recreational Fishing in Canada, be adopted.

 
Pursuant to the Order of Reference of Thursday, September 18, 2014, the Committee resumed consideration of Bill S-3, An Act to amend the Coastal Fisheries Protection Act.
 

The witness answered questions.

 

The Committee commenced its clause-by-clause study of the Bill.

 

Pursuant to Standing Order 75(1), consideration of Clause 1, Alternative Title, was postponed.

The Chair called Clause 2.

 

Clause 2 carried.

 

Clause 3 carried.

 

On Clause 4,

Randy Kamp moved, — That Bill S-3, in Clause 4, be amended by adding after line 18 on page 4 the following:

“(3) No person shall import any fish or marine plant that is not accompanied by the documentation required by regulation.”

 

After debate, the question was put on the amendment of Randy Kamp and it was agreed to.

 

Clause 4, as amended, carried.

 

On Clause 5,

Randy Kamp moved, — That Bill S-3, in Clause 5, be amended by adding after line 45 on page 4 the following:

(2.1) Section 6 of the Act is amended by adding the following after paragraph (d):

“(d.1) respecting documentation required for the importation of fish and marine plants;”

 

After debate, the question was put on the amendment of Randy Kamp and it was agreed to.

On Clause 9,

Randy Kamp moved, — That Bill S-3, in Clause 9, be amended by

(a) replacing line 5 on page 13 with the following:

“9. Paragraphs 14(a) to (c) of the Act are replaced”

(b) replacing lines 7 to 9 on page 13 with the following:

“(a) any fishing vessel seized under paragraph 9(1)(a) by means of or in relation to which the offence was committed, or, if the vessel has been sold, the proceeds of the sale,

(b) any goods aboard a fishing vessel described in paragraph (a), including fish, marine plants, tackle, rigging, apparel, furniture, stores and cargo, or, if any of the goods have been sold under section 11, the proceeds of the sale,

(b.1) any goods seized under paragraph 9(1)(b) in any other place, including fish, marine plants, tackle, rigging, apparel, furniture, stores and cargo, by means of or in relation to which the offence was committed, or that were obtained by or used in the commission of the offence, or, if any of the goods have been sold under section 11, the proceeds of the sale, or

(c) any fishing vessel described in paragraph (a), or the proceeds of the sale of the vessel, and any of the goods described in paragraph (b) or (b.1), or the proceeds of the sale of the goods,”

 

After debate, the question was put on the amendment of Randy Kamp and it was agreed to.

On Clause 16,

Randy Kamp moved, — That Bill S-3, in Clause 16, be amended by adding after line 33 on page 18 the following:

“(3) Every person who contravenes subsection 5.6(3) is guilty of an offence and liable

(a) on conviction on indictment, to a fine of not more than $500,000; or

(b) on summary conviction, to a fine of not more than $100,000.”

 

The question was put on the amendment of Randy Kamp and it was agreed to, by a show of hands: YEAS: 5; NAYS: 4.

 

Yvon Godin moved, — That Clause 16 be stood until the next meeting.

Debate arose thereon.

The question was put on the motion and it was negatived, by a show of hands: YEAS: 4; NAYS: 5.

 

Clause 16, as amended, carried by a show of hands: YEAS: 5; NAYS: 4.

 

Clause 17 carried.

 

Clause 18 carried.

 

Clause 19 carried.

 

Clause 1, Alternative Title, carried.

 

The Title carried.

 

The Bill, as amended, carried.

 

ORDERED, — That the Chair report the Bill, as amended, to the House.
