The Standing Committee on Justice and Human Rights met at 3:30 p.m. this day, in Room 306, La Promenade Building, the Vice-Chair, Françoise Boivin, presiding.

 

Members of the Committee present: Françoise Boivin, Raymond Côté, Kerry-Lynne D. Findlay, Robert Goguen, Pierre Jacob, Brian Jean, Craig Scott and Kyle Seeback.

 

Acting Members present: Hon. Denis Coderre for Hon. Irwin Cotler, Sadia Groguhé for Craig Scott, Tom Lukiwski for Brian Jean, Joe Preston for Dan Albas and Kevin Sorenson for Dan Albas.

 

In attendance: Library of Parliament: Tanya Dupuis, Analyst; Cynthia Kirkby, Analyst.

 

Witnesses: As an individual: Joanne Jong. Association of Families of Persons Assassinated or Disappeared: Michel Surprenant, President; Bruno Serre, Vice-President. Canadian Parents of Murdered Children and Survivors of Homicide Victims Inc.: Yvonne Harvey, Chair and co-founder. BC Bereavement Helpline: Christopher Ducharme, President, Founder, BC Victims of Homicide.

 

Denis Coderre moved, — That the Committee conduct a study on the subject matter of the section of Bill C-45, A second Act to implement certain provisions of the budget tabled in Parliament on March 29, 2012 and other measures, which directly fall within the mandate of this Committee, namely Part 4, Division 9, The Judges Act and report of its findings to the House no later than Monday, November 5, 2012.

Debate arose thereon.

 

Brian Jean moved, — That the motion be amended by adding at the beginning of the motion “That the Committee shall go immediately in camera to discuss the following motion”.

 

The Chair ruled the amendment is inadmissible as it changes the intent of the motion.

 

Whereupon, Brian Jean appealed the decision of the Chair.

The question: "Shall the decision of the Chair be sustained?" was put and the decision was overturned on the following recorded division: YEAS: Denis Coderre, Raymond Côté, Pierre Jacob, Craig Scott — 4; NAYS: Kerry-Lynne D. Findlay, Robert Goguen, Brian Jean, Joe Preston, Kyle Seeback, Kevin Sorenson — 6.

 

After debate, the question was put on the amendment of Brian Jean and it was agreed to on the following recorded division: YEAS: Kerry-Lynne D. Findlay, Robert Goguen, Brian Jean, Joe Preston, Kyle Seeback, Kevin Sorenson — 6; NAYS: Denis Coderre, Raymond Côté, Pierre Jacob, Craig Scott — 4.

 

At 3:45 p.m., the sitting was suspended.

At 3:48 p.m., the sitting resumed in camera.

 

At 3:49 p.m., the sitting was suspended.

At 3:50 p.m., the sitting resumed in public.

 
Pursuant to the Order of Reference of Tuesday, October 16, 2012, the Committee resumed consideration of Bill C-37, An Act to amend the Criminal Code.
 

Joanne Jong, Michel Surprenant and Bruno Serre made statements and answered questions.

 

At 4:31 p.m., the sitting was suspended.

At 4:36 p.m., the sitting resumed.

 

Yvonne Harvey and Christopher Ducharme made statements and answered questions.
