The Standing Committee on Justice and Human Rights met at 11:10 a.m. this day, in Room 214, Wellington Building, the Chair, Ed Fast, presiding.

 

Members of the Committee present: Joe Comartin, Bob Dechert, Ed Fast, Marc Lemay, Serge Ménard, Alexandra Mendes, Brian Murphy, Rick Norlock, Daniel Petit, Brent Rathgeber and Stephen Woodworth.

 

Acting Members present: Paul Calandra for Stephen Woodworth, Hon. Ujjal Dosanjh for Hon. Dominic LeBlanc and Yvon Lévesque for Marc Lemay.

 

In attendance: Library of Parliament: Robin MacKay, Analyst; Dominique Valiquet, Analyst.

 

Appearing: Hon. Rob Nicholson, P.C., M.P., Minister of Justice.

 

Witnesses: Department of Justice: John H. Sims, Deputy Minister of Justice and Deputy Attorney General of Canada.

 
Pursuant to Standing Order 108(2) and the motion adopted by the Committee on Tuesday, March 16, 2010, the Committee commenced its examination of departmental expenditure plans.
 

The Minister made a statement and, with John H. Sims, answered questions.

 
The Committee proceeded to the consideration of matters related to Committee business.
 

Joe Comartin moved, — That the Committee conduct two days of hearings on the case of Mr. Rahim Jaffer and that the Federal Director of Public Prosecutions, the Provincial Prosecutor or a designate from the Attorney General of Ontario and a senior representative of the Ontario Provincial Police appear as witnesses before the Committee and that the Committee prepare a report of its investigation to the House of Commons.

 

The Chair ruled the motion inadmissible as it exceeded the scope of the Committee's mandate.

 

Whereupon, Brian Murphy appealed the decision of the Chair.

The question: "Shall the decision of the Chair be sustained?" was put and the decision was overturned on the following recorded division: YEAS: — 0; NAYS: Joe Comartin, Ujjal Dosanjh, Yvon Lévesque, Serge Ménard, Alexandra Mendes, Brian Murphy — 6.

 

The Committee resumed consideration of the motion of Joe Comartin, — That the Committee conduct two days of hearings on the case of Mr. Rahim Jaffer and that the Federal Director of Public Prosecutions, the Provincial Prosecutor or a designate from the Attorney General of Ontario and a senior representative of the Ontario Provincial Police appear as witnesses before the Committee and that the Committee prepare a report of its investigation to the House of Commons.

 

After debate, the question was put on the motion and it was negatived, by a show of hands: YEAS: 2; NAYS: 7.

 

At 12:51 p.m., the sitting was suspended.

At 12:51 p.m., the sitting resumed in camera.

 

At 12:57 p.m., the Committee adjourned to the call of the Chair.
