The Standing Committee on Aboriginal Affairs, Northern Development and Natural Resources met at 9:24 a.m. this day, in Room 269 West Block, the Chair, Guy St-Julien, presiding.

 

Members of the Committee present: Larry Bagnell, John Duncan, André Harvey, Nancy Karetak-Lindell, Rick Laliberte, Yvan Loubier, Guy St-Julien, Chuck Strahl, Andrew Telegdi and Maurice Vellacott.

 

Acting Members present: Pauline Picard for Yvan Loubier, Raymond Simard for Brenda Chamberlain, Diane St-Jacques for Stan Dromisky and Robert Thibault for Lawrence O'Brien.

 

In attendance: House of Commons: Susan Baldwin, Legislative Clerk. Library of Parliament: Mary Hurley, Analyst; Jean-Luc Bourdages, Analyst.

 

Witnesses: Department of Indian Affairs and Northern Development : Gilberte Fleischmann, Director, Self-Government Negotiations. Justice Canada: Bruce Littlejohn, Senior Counsel. Land Claims Negotiations: Al Gross, Negotiator.

 
Pursuant to the Order of Reference of Thursday, February 12, 2004, the Committee resumed consideration of Bill C-11, An Act to give effect to the Westbank First Nation Self-Government Agreement.
 
On Clause 2,
 
On motion of Larry Bagnell, it was agreed, — That Bill C-11, in Clause 2, be amended by replacing, in the English version, line 23 on page 1 with the following:

"Westbank lands" and "Westbank law" have

 

Clause 2, as amended, carried.

 

Clauses 3 to 13 inclusive carried severally.

 

Clause 14 carried.

 
On New Clause 14.1,
 
On motion of Larry Bagnell, it was agreed, — That Bill C-11 be amended by adding after line 42 on page 3 the following new clause:

14.1 (1) For the purposes of subsection 29(3) of the Canada Lands Surveys Act , in relation to Westbank lands, surveys and plans must be satisfactory to the council rather than to the Minister of Indian Affairs and Northern Development.

(2) Subsection (1) does not apply in relation to boundaries between Westbank lands and other lands.

 

Clauses 15 to 20 inclusive carried severally.

 
On Clause 21,
 
On motion of Larry Bagnell, it was agreed, — That Bill C-11, in Clause 21, be amended by replacing line 18 on page 6 with the following:

21. If Bill C-8, introduced in the 3rd

 

Clause 21, as amended, carried.

 

Clause 22 carried.

 

The Short Title carried.

 

The Preamble carried.

 

The Title carried.

 

The Bill, as amended, carried.

 

ORDERED, — That the Chair report the Bill ,as amended, to the House.

 

The question: "That Bill C-11, as amended, be reprinted for the use of the House at report stage" was put and was negatived.

 

Debate resumed on the motion — That the Committee hold hearings in Westbank, British Columbia, next week.

 

After debate, the question was put on the motion and it was negatived on the following recorded division: YEAS: Larry Bagnell, John Duncan, Chuck Strahl, Maurice Vellacott — 4; NAYS: André Harvey, Nancy Karetak-Lindell, Rick Laliberte, Yvan Loubier, Pauline Picard, Andrew Telegdi — 6.
