The committee proceeded to the consideration of matters related to committee business.

The committee resumed consideration of the motion, as amended, of Doug Shipley moved on Wednesday, September 27, 2023, which read as follows:

That the committee hold a meeting on the right of crime victims and the security reclassification and transfer of offenders within federal corrections, and that the committee invite Commissioner of Correctional Service Canada Anne Kelly, Deputy Minister Shawn Tupper, and officials of Justice and Public Safety Canada to appear,

and of the amendment of Dane Lloyd moved on Wednesday, September 27, 2023, which read as follows:

That the motion, as amended, be amended by adding after the words “Public Safety Canada” the following: “, the Correctional Investigator of Canada and the Federal Ombudsman for victims of crime,”

The debate continued.

Jennifer O'Connell moved, — That the committee resume consideration of Bill C-20.

The question was put on the motion and it was agreed to on the following recorded division:

Pursuant to the order of reference of Friday, November 25, 2022, the committee resumed consideration of Bill C-20, An Act establishing the Public Complaints and Review Commission and amending certain Acts and statutory instruments.

The committee resumed its clause-by-clause study of the Bill.

Motion

Garnett Genuis moved, — That the committee not proceed with clause-by-clause on Bill C-20 until is has disposed of the motion respecting the Paul Bernardo transfer and the invitation to representatives of the victims' families.

Debate arose thereon.

RULING BY THE CHAIR

The Chair ruled the motion admissible.

Whereupon, Jennifer O'Connell appealed the decision of the Chair.

The question: "Shall the decision of the Chair be sustained?" was put and the decision was overturned on the following recorded division:

Garnett Genuis moved, — That the committee not proceed any further with clause-by-clause on Bill C-20.

RULING BY THE CHAIR

The Chair ruled the proposed motion inadmissible as the previous decision of the committee must stand and cannot be questioned again.

Garnett Genuis moved, — That the committee report to the House that we have reached an impasse about studying the transfer of Paul Bernardo to a medium-security facility, and that the chair inform the House that as a result, the consideration of Bill C-20 will be delayed.

Debate arose thereon.

At 5:14 p.m., the sitting was suspended.

At 5:29 p.m., the sitting resumed.

The debate continued.

Garnett Genuis moved, — That the committee invite additional witnesses to appear in regard to Bill C-20 and that any new amendments to the bill be submitted to the clerk within 48 hours of the completion of the agreed upon witness meetings.
