The committee proceeded to the consideration of matters related to committee business.

It was agreed, — That the proposed budget in the amount of $ 2,950.00, for the study of the certificate of nomination of Harriet Solloway to the position of Public Sector Integrity Commissioner, be adopted.

Pursuant to the order of reference of Wednesday, February 15, 2023, the committee resumed consideration of Bill C-290, An Act to amend the Public Servants Disclosure Protection Act.

The witnesses answered questions.

The committee resumed its clause-by-clause study of the Bill.

The committee resumed clause-by-clause consideration on new Clause 42 of the Bill.

The committee resumed consideration of the amendment of Greg Fergus, — That Bill C-290 be amended by adding after line 14 on page 12 the following:

“Coming into Force

42 This Act comes into force on the second anniversary of the day on which it receives royal assent.”

Julie Vignola moved, — That the amendment be amended by replacing the words “on the second anniversary of” with the words “six months after”.

Debate arose thereon.

By unanimous consent, the subamendment was withdrawn.

Julie Vignola moved, — That the amendment be amended by replacing the word “second” with the word “first”.

After debate, the question was put on the subamendment and the result of the vote was announced:

YEAS: Michael Barrett, Kelly Block, Gord Johns, Philip Lawrence, Julie Vignola — 5;

NAYS: Parm Bains, Anthony Housefather, Majid Jowhari, Irek Kusmierczyk, Joanne Thompson — 5.

Whereupon, the Chair voted in the affirmative.

Accordingly, the motion was agreed to.

Debate resumed on the amendment of Greg Fergus, as amended.

The question was put on the amendment of Greg Fergus, as amended, and it was agreed to on the following recorded division:

Majid Jowhari moved, — That Bill C-290 be amended by adding after line 14 on page 12 the following new clause:

“42 The portion of section 68 of the Conflict of Interest Act before paragraph (a) is replaced by the following:

68 If a matter is referred to the Commissioner under subsection 12.1(1) or 24(2.1) of the Public Servants Disclosure Protection Act, the Commissioner shall”

After debate, the question was put on the amendment of Majid Jowhari and it was agreed to on division.

The committee reverted to Clause 10 previously stood.

The committee resumed consideration of the amendment of Gord Johns, — That Bill C-290, in Clause 10, be amended by replacing lines 3 and 4 on page 5 with the following:

“file a complaint with the Commissioner. The complaint may also be”

By unanimous consent, the amendment was withdrawn.

Anthony Housefather moved, — That Bill C-290, in Clause 10, be amended by deleting line 11 on page 5.

After debate, the question was put on the amendment of Anthony Housefather and it was agreed to on the following recorded division:

Julie Vignola moved, — That Bill C-290, in Clause 38, be amended by replacing lines 15 to 18 on page 11 with the following:

“disclose the identity of a person making a disclosure and of a witness, with the consent of that person.”

“An Act to amend the Public Servants Disclosure Protection Act and to make a consequential amendment to the Conflict of Interest Act”

The question was put on the amendment of Anthony Housefather and it was agreed to on division.

The Title, as amended, carried on division.

The Bill, as amended, was adopted.

ORDERED, — That the Chair report the Bill, as amended, to the House.

ORDERED, — That Bill C-290, as amended, be reprinted for the use of the House of Commons at report stage.
