Pursuant to Standing Order 108(2) and the motion adopted by the committee on Thursday, October 29, 2020, the committee resumed its study of the targeted infrastructure investment.

The Minister made a statement and, with the other witnesses, answered questions.

Motion

Andrew Scheer moved, — That the committee resume consideration of the motion moved by Stephanie Kusie, on Thursday, April 29, 2021, which read as follows:

That, pursuant to Standing Order 108(1)(a), an order of this committee do issue for a copy of all relevant documents relating to the agreement signed with ITC holdings regarding the Lake Erie Connector, including, but not limited to, the agreement itself, all correspondence between ITC Holdings and the CIB, any appendices, terms of a repayment schedule, the Bank’s evaluation of the project and any other relevant documents in an unredacted form within 20 days of the adoption of this order.

The question was put on the motion and it was agreed to on the following recorded division:

YEAS: Taylor Bachrach, Xavier Barsalou-Duval, Fayçal El-Khoury, Andy Fillmore, Gudie Hutchings, Angelo Iacono, Helena Jaczek, Stephanie Kusie, Andrew Scheer, Doug Shipley, Gerald Soroka — 11;

NAYS: — 0.

Debate arose thereon.

Amendment

Andy Fillmore moved, — That the motion be amended by replacing the words “20 days” with the words “45 days”.

After debate, the question was put on the amendment of Andy Fillmore and it was negatived on the following recorded division:

NAYS: Taylor Bachrach, Xavier Barsalou-Duval, Stephanie Kusie, Andrew Scheer, Doug Shipley, Gerald Soroka — 6.

Amendment

Taylor Bachrach moved, — That the motion be amended by replacing the words “20 days” with the words “30 days”.

After debate, the question was put on the amendment of Taylor Bachrach and it was agreed to on the following recorded division:

The motion, as amended, read as follows:

That, pursuant to Standing Order 108(1)(a), an order of this committee do issue for a copy of all relevant documents relating to the agreement signed with ITC holdings regarding the Lake Erie Connector, including, but not limited to, the agreement itself, all correspondence between ITC Holdings and the CIB, any appendices, terms of a repayment schedule, the Bank’s evaluation of the project and any other relevant documents in an unredacted form within 30 days of the adoption of this order.

Amendment

Andrew Scheer moved, — That the motion be amended by replacing all the words after “Standing Order 108(1)(a),” with the following:

“the committee order the Canada Infrastructure Bank (CIB) to produce a copy of all documents relating to the agreement signed with ITC holdings (ITC) regarding the Lake Erie Connector, including the agreement itself, any its appendices or schedules, all correspondence between ITC and the CIB, terms of any repayment schedule, any CIB’s evaluation of the project and any other relevant documents;

That the documents be provided in an unredacted form to the Law Clerk and Parliamentary Counsel within 30 days of the adoption of this order;

That the Law Clerk and Parliamentary Counsel redact from the documents, except for the agreement itself, its appendices or schedules: (a) any information that constitutes a trade secret, (b) any information the disclosure of which could reasonably result in material financial loss or gain to ITC or a third party or prejudice their competitive position, (c) any information the disclosure of which could reasonably interfere with contractual or other negotiations of ITC or a third party, and (d) any personal private information;

That the CIB, in consultation with ITC, may propose redactions to the Law Clerk and Parliamentary Counsel respecting the information that should be redacted pursuant to this order; and

That the Law Clerk and Parliamentary Counsel provide the redacted documents to the committee as soon as the redactions are completed ”.

Debate arose thereon.

At 8:28 p.m., the sitting was suspended.

At 8:38 p.m., the sitting resumed.

Helena Jaczek moved, — That the committee do now adjourn.

The question was put on the motion and it was negatived on the following recorded division:
