Pursuant to the order of reference of Tuesday, February 16, 2021, and of Monday, June 7, 2021, the committee resumed consideration of Bill C-10, An Act to amend the Broadcasting Act and to make related and consequential amendments to other Acts.

The committee resumed its clause-by-clause study of the Bill.

The Committee resumed clause-by-clause consideration on Clause 8 of the Bill, as amended.

“(4) Regulations made under this section, other than regulations made under paragraph (1)(i) or (j), do not apply with respect to programs that are uploaded to an online undertaking that provides a social media service by a user of the service — if that user is not the provider of the service or the provider’s affiliate, or the agent or mandatary of either of them — for transmission over the Internet and reception by other users of the service.”

(2) The Commission shall hold a public hearing in connection with the amendment or renewal of an order made under subsections 9.1(1) and 11.1(2) or a licence unless the Commission considers that such a hearing is not required in the public interest.”

By unanimous consent, the amendment was withdrawn.

Garnett Genuis moved, — That Bill C-10 be amended by adding after line 7 on page 14 the following new clause:

“13.1 The Act is amended by adding the following after section 22:

22.1 (1) No licence shall be issued, amended or renewed under this Part in relation to a broadcasting undertaking, including one that distributes foreign programming, that, in the opinion of the Commission, is subject to direction or control by a foreign state that is not a democratic state or that is committing, or is governed by a party who has committed, genocide or crimes against humanity.

(2) If the Commission is of the opinion that a broadcasting undertaking which has been issued a licence meets the criteria set out in subsection (1), it must, despite section 24, immediately suspend the licence until an investigation of the matter has been completed.

(3) Any licence issued, amended or renewed in contravention of this section is of no force or effect.”

The Chair ruled the proposed amendment inadmissible because it was beyond the scope of the Bill, as provided on page 770 of House of Commons Procedure and Practice, Third Edition.

Whereupon, Garnett Genuis appealed the decision of the Chair.

22.1 (1) No licence shall be issued, amended or renewed under this Part in relation to a broadcasting undertaking, including one that distributes foreign programming, that transmits, produces or participates in the production of forced confessions, except where brief audio-visual portions of such confessions are transmitted as part of a news program.

(2) After receiving a complaint in relation to subsection (1), the Commission must, without delay, investigate the complaint and publish a report on the matter on its website within 30 days following receipt of the complaint.

(3) If the Commission, after completing its investigation under subsection (2), is of the opinion that a broadcasting undertaking which has been issued a licence meets the criteria set out in subsection (1), it must, despite section 24, immediately suspend the licence.

(4) Any licence issued, amended or renewed in contravention of this section is of no force or effect.”

The committee proceeded to the consideration of matters related to committee business.

On motion of Kevin Waugh, it was agreed, — That the Committee invite officials from the Department of Canadian Heritage to testify about the funding for the discovery of the remains of two hundred and fifteen Indigenous children on the grounds of a former residential school in Kamloops, and what would be required to extend these efforts to all residential schools where unmarked graves may exist; and that Chief Rosanne Casimir of the Tk’emlúps te Secwépemc First Nation be invited to discuss the process of obtaining funding, how sufficient it was relative to the task, and what remains to be done.
