The Standing Committee on Transport, Infrastructure and Communities met at 3:31 p.m. this day, in Room 306, The Valour Building, the Vice-Chair, Hoang Mai, presiding.

 

Members of the Committee present: Peter Braid, Ed Komarnicki, Hoang Mai, Isabelle Morin, Mike Sullivan, Jeff Watson, Wai Young and David Yurdiga.

 

Acting Members present: Francis Scarpaleggia for David J. McGuinty.

 

In attendance: House of Commons: Philippe Méla, Legislative Clerk. Library of Parliament: Allison Padova, Analyst.

 

Witnesses: Department of Transport: Rachel Heft, Legal Counsel; Brigitte Diogo, Director General, Rail Safety.

 
Pursuant to the Order of Reference of Tuesday, January 27, 2015, the Committee resumed consideration of Bill C-627, An Act to amend the Railway Safety Act (safety of persons and property).
 

The Committee commenced its clause-by-clause study of the Bill.

 

Brigitte Diogo and Rachel Heft answered questions.

 

The Chair called Clause 1.

 

Clause 1 carried.

 

On Clause 2,

Isabelle Morin moved, — That Bill C-627, in Clause 2, be amended

(a) by replacing line 22 on page 1 with the following:

“property or to the environment, the inspector”

(b) by replacing line 8 on page 2 with the following:

“property or the environment, the inspector, by notice sent to the”

(c) by replacing line 18 on page 2 with the following:

“operations or the safety of persons or property or the environment,”

(d) by replacing line 28 on page 2 with the following:

“persons or property or the environment, the inspector, by notice sent”

 

After debate, the question was put on the amendment of Isabelle Morin and it was negatived, by a show of hands: YEAS: 2; NAYS: 5.

 

Clause 2 carried.

 

Clause 3 carried.

 

On Clause 4,

Jeff Watson moved, — That Bill C-627, in Clause 4, be amended by

(a) replacing line 22 on page 3 with the following:

made under subsection 32(1) or (3.1) shall

(b) replacing line 26 on page 3 with the following:

or (3.2) shall not be stayed pending a review under

 

After debate, the question was put on the amendment of Jeff Watson and it was agreed to.

 

Clause 4, as amended, carried.

 

The Title carried.

 

The Bill , as amended, carried.

 

ORDERED, — That the Chair report the Bill , as amended, to the House.

 

ORDERED, — That Bill C-627, as amended, be reprinted for the use of the House at report stage.

 
The Committee proceeded to the consideration of matters related to Committee business.
 

By unanimous consent, Isabelle Morin moved, — That, pursuant to Standing Order 108(2), the Committee undertake a study on the recent ministerial order pertaining to air transportation, to study the impacts on the safety of passengers and the mental health of crew members; that the Minister of Transport, officials from Transport Canada, Industry as well as Labor representatives be invited to appear during the course of the study; and that every effort be made to ensure that the meetings in relation to the study be televised.

Debate arose thereon.

 

Jeff Watson moved, — That the Committee proceed to sit in camera.

 

The question was put on the motion and it was agreed to, by a show of hands: YEAS: 5; NAYS: 3.

 

At 3:45 p.m., the sitting was suspended.

At 3:47 p.m., the sitting resumed in camera.

 

It was agreed, — That, should Bill C-52, An Act to amend the Canada Transportation Act and the Railway Safety Act, be referred to the Committee, members of the Committee submit their lists of witnesses to the Clerk of the Committee by Friday, April 10, 2015.

 

It was agreed, — That, should Bill C-52 be referred to the Committee, the Committee dedicate up to three meetings to hear witnesses and then proceed to the clause-by-clause study of the Bill.

 

At 4:02 p.m., the Committee adjourned to the call of the Chair.
