The Standing Committee on Human Resources, Skills and Social Development and the Status of Persons with Disabilities met at 3:37 p.m. this day, in Room 253-D, Centre Block, the Chair, Ed Komarnicki, presiding.

 

Members of the Committee present: Brad Butt, Jean Crowder, Rodger Cuzner, Carol Hughes, Ed Komarnicki, Kellie Leitch, Colin Mayes, Phil McColeman, Claude Patry and Devinder Shory.

 

Acting Members present: Wladyslaw Lizon for Joe Daniel and Marc-André Morin for Manon Perreault.

 

In attendance: Library of Parliament: André Léonard, Analyst; Sandra Gruescu, Analyst. House of Commons: Wayne Cole, Legislative Clerk.

 
Pursuant to the Order of Reference of Wednesday, November 30, 2011, the Committee resumed consideration of Bill C-316, An Act to amend the Employment Insurance Act (incarceration).
 

The Committee commenced its clause-by-clause study of the Bill.

 

On Clause 1,

Kellie Leitch moved, — That Bill C-316, in Clause 1, be amended by replacing line 5 on page 1 with the following:

Insurance Act is replaced by the following:

(b) confined in a jail, penitentiary or other similar institution and was not found guilty of the offence for which the person was being held or any other offence arising out of the same transaction;

 

After debate, the question was put on the amendment of Kellie Leitch and it was agreed to, by a show of hands: YEAS: 6; NAYS: 5.

 

After debate, Clause 1, as amended, carried by a show of hands: YEAS: 6; NAYS: 5.

 

On Clause 2,

Kellie Leitch moved, — That Bill C-316, in Clause 2, be amended by replacing line 7 on page 1 with the following:

replaced by the following:

(a) confined in a jail, penitentiary or other similar institution and was not found guilty of the offence for which the claimant was being held or any other offence arising out of the same transaction;

 

After debate, the question was put on the amendment of Kellie Leitch and it was agreed to, by a show of hands: YEAS: 6; NAYS: 5.

 

After debate, Clause 2, as amended, carried by a show of hands: YEAS: 6; NAYS: 5.

 

On Clause 3,

Kellie Leitch moved, — That Bill C-316, in Clause 3, be amended by replacing line 9 on page 1 with the following:

replaced by the following:

(a) confined in a jail, penitentiary or other similar institution and were not found guilty of the offence for which they were being held or any other offence arising out of the same transaction;

 

The question was put on the amendment of Kellie Leitch and it was agreed to, by a show of hands: YEAS: 6; NAYS: 5.

 

Clause 3, as amended, carried by a show of hands: YEAS: 6; NAYS: 5.

 

On New Clause 4,

Kellie Leitch moved, — That Bill C-316 be amended by adding after line 9 on page 1 the following: 4. Paragraphs 10(10)(a) and 152.11(11)(a) of the Employment Insurance Act, as enacted by sections 2 and 3, respectively, do not apply to the benefit period of a claimant or a self-employed person, as the case may be, in respect of any week for which the claimant or the self-employed person was confined in a jail, penitentiary or other similar institution before the coming into force of this Act.

 

The question was put on the amendment of Kellie Leitch and it was agreed to, by a show of hands: YEAS: 6; NAYS: 5.

 
Kellie Leitch moved, — That Bill C-316 be amended by adding after line 9 on page 1 the following:

4. This Act comes into force on the first Sunday after the day on which it receives royal assent.

 

The question was put on the amendment of Kellie Leitch and it was agreed to, by a show of hands: YEAS: 6; NAYS: 5.

 

The Title carried by a show of hands: YEAS: 6; NAYS: 5.

 

The Bill, as amended, carried by a show of hands: YEAS: 6; NAYS: 5.

 

ORDERED, — That the Chair report the Bill, as amended, to the House.

 

ORDERED, — That Bill C-316, as amended, be reprinted for the use of the House at report stage.
