The Standing Committee on Industry, Science and Technology met at 3:30 p.m. this day, in Room 269, West Block, the Chair, Walt Lastewka, presiding.

Members of the Committee present: André Bachand, Larry Bagnell, Paul Crête, Nick Discepola, Brian Fitzpatrick, Walt Lastewka, Serge Marcil, Brian Masse, Dan McTeague, James Rajotte, Andy Savoy, Brent St. Denis, Paddy Torsney and Joseph Volpe.

Acting Members present: Rose-Marie Ur for Paddy Torsney and Gérard Asselin for Jocelyne Girard-Bujold.

Other Member present: Janko Perić.

In attendance: From the Library of Parliament: Geoffrey P. Kieley and Dan Shaw, Research Officers.

Witnesses: From the Department of Industry: Bruce Bergen, Legal Counsel; Gaëtan Champagne, Lobbyist Registration Advisor.

Pursuant to its Order of Reference of Friday, October 25, 2002, the Committee resumed consideration of Bill C-15, An Act to amend the Lobbyists Registration Act (See Minutes of Proceedings, Thursday, November 21, 2002, Meeting No. 3).

The Committee proceeded to Clause-by-Clause consideration of the Bill.

At 4:25 p.m., the sitting was suspended.

At 4:26 p.m., the Committee proceeded to sit in public.

Dan McTeague moved, -- That the House of Commons Standing Committee on Industry, Science and Technology review at its earliest opportunity the pharmaceutical industry practices related to patent protection, specifically, the practices of ‘evergreening’ and the notice of compliance regulations.  This review should ensure that there is an appropriate balance between the protection of intellectual property and the need to contain costs and provide Canadians with improved access to non-patented prescription drugs.

And debate arose.

James Rajotte moved the following amendment, -- That the motion be amended by deleting everything after “opportunity” and by adding “ a study on the automatic injunction notice of the Patented Medicines (notice of compliance) Regulations under the Patent Act".

And debate arose.

Nick Discepola moved the following sub-amendment, -- That the following be added “within the context of the work plan already adopted by the Committee on November 27, 2002, and in view of the productivity study that is to begin March 17, 2003”.

By unanimous consent, it was agreed, -- That the proposed budget in the amount of $60,000 for the period of January 28, 2003 to March 21, 2003 be adopted and that the Chair present the said budget to the Budget sub committee of the Liaison Committee.

By unanimous consent, it was agreed, -- That the proposed budget in the amount of $10,500 for the period of December 4, 2002 to December 13, 2002 be adopted and that the Chair present the said budget to the Budget sub committee of the Liaison Committee.
