The Standing Committee on Canadian Heritage met at 11:08 a.m. this day, in Room 7-52, 131 Queen Street, the Vice-Chair, Pierre Nantel, presiding.

 

Members of the Committee present: Scott Armstrong, Tyrone Benskin, Gordon Brown, Paul Calandra, Andrew Cash, Parm Gill, Jim Hillyer, Pierre Nantel, Scott Simms and Terence Young.

 

Acting Members present: Robert Aubin for Marjolaine Boutin-Sweet and Maurice Vellacott for Hon. Rob Moore.

 

In attendance: Library of Parliament: Michael Dewing, Analyst; Marion Ménard, Analyst.

 

Witnesses: House of Commons: John Carmichael, M.P., Don Valley West.

 
Pursuant to the Order of Reference of Wednesday, February 1, 2012, the Committee commenced consideration of Bill C-288, An Act respecting the National Flag of Canada.
 

The Committee commenced its clause-by-clause study of the Bill.

 

John Carmichael made a statement.

 

Pursuant to Standing Order 75(1), consideration of the Preamble and Clause 1 were postponed.

The Chair called Clause 2.

 

On Clause 2,

Paul Calandra moved, — That Bill C-288, in Clause 2, be amended by replacing the heading before line 19 on page 1 and line 19 on page 1 to line 3 on page 2 with the following:

DISPLAYING THE NATIONAL FLAG

2. (1) All Canadians are encouraged to proudly display the National Flag of Canada in accordance with flag protocol.

(2) Every person who is in control of an apartment building, a condominium building or building in divided co-ownership or another multiple-residence building or a gated community is encouraged to allow the National Flag of Canada to be displayed in accordance with flag protocol.

 

After debate, by unanimous consent, Clause 2 and the amendment were stood.

 

By unanimous consent, the witness answered questions.

 

At 11:46 a.m., the sitting was suspended.

At 11:50 a.m., the sitting resumed.

 

By unanimous consent, the Committee reverted to Clause 2 and the amendment of Paul Calandra, previously stood.

 

After debate, at 12:14 p.m., the sitting was suspended.

At 12:19 p.m., the sitting resumed.

 

After further debate, at 12:20 p.m., the sitting was suspended.

At 12:22 p.m., the sitting resumed.

 

After debate, the question was put on the amendment of Paul Calandra and it was agreed to, by a show of hands: YEAS: 8; NAYS: 3.

 

Clause 2, as amended, carried on division.

 

On Clause 3,

Tyrone Benskin moved, — That Bill C-288 be amended by deleting Clause 3.

 

The Chair ruled the proposed amendment inadmissible because it proposed the deletion of the clause, as provided on page 768 of House of Commons Procedure and Practice, Second Edition.

 

Clause 3 was negatived unanimously.

 

After debate, the Short Title carried.

 

On Preamble,

Paul Calandra moved, — That Bill C-288, in the Preamble, be amended by replacing lines 12 and 13 on page 1 with the following:

“interest to encourage the displaying of the National Flag;”

 

The question was put on the amendment of Paul Calandra and it was agreed to.

 

The Title carried by a show of hands: YEAS: 8; NAYS: 3.

 

The Bill, as amended, carried on a show of hands: YEAS: 8; NAYS: 3.

 

ORDERED, — That the Chair report the Bill, as amended, to the House.

 

ORDERED, — That Bill C-288, as amended, be reprinted for the use of the House at report stage.

 

At 12:34 p.m., the sitting was suspended.

At 12:37 p.m., the sitting resumed in camera.

 
Pursuant to Standing Order 108(2) and the motion adopted by the Committee on Tuesday, September 27, 2011, the Committee resumed its study of Canada's 150th anniversary in 2017.
 
The Committee proceeded to the consideration of matters related to Committee business.
 

It was agreed, — That once a Legislative Committee is formed to study Bill C-11, the Standing Committee suspend its meetings until the Legislative Committee completes its study of the said Bill.

 

At 12:56 p.m., the Committee adjourned to the call of the Chair.
