Presenting Petitions

Pursuant to Standing Order 36, petitions certified correct by the Clerk of Petitions were presented as follows:

Government Orders

The House resumed consideration of the motion of Mr. Nicholson (Minister of Justice), seconded by Mr. Kent (Minister of the Environment), — That Bill S-6, An Act to amend the Criminal Code and another Act, be now read a third time and do pass.

The question was put on the motion and, pursuant to Standing Order 45, the recorded division was deferred until Wednesday, February 2, 2011, at the expiry of the time provided for Government Orders.


The Order was read for the consideration at report stage of Bill C-48, An Act to amend the Criminal Code and to make consequential amendments to the National Defence Act, as reported by the Standing Committee on Justice and Human Rights with an amendment.

Mr. Fletcher (Minister of State (Democratic Reform)) for Mr. Nicholson (Minister of Justice), seconded by Mr. Merrifield (Minister of State (Transport)), moved, — That the Bill, as amended, be concurred in at report stage.

The question was put on the motion and it was agreed to on division.

Accordingly, the Bill, as amended, was concurred in at report stage.

Pursuant to Standing Order 76.1(11), Mr. Fletcher (Minister of State (Democratic Reform)) for Mr. Nicholson (Minister of Justice), seconded by Mr. Merrifield (Minister of State (Transport)), moved, — That the Bill be now read a third time and do pass.

Government Orders

The House resumed consideration of the motion of Mr. Nicholson (Minister of Justice), seconded by Mr. Merrifield (Minister of State (Transport)), — That Bill C-48, An Act to amend the Criminal Code and to make consequential amendments to the National Defence Act, be now read a third time and do pass.

The debate continued.

The question was put on the motion and it was agreed to.

Accordingly, the Bill was read the third time and passed.


The Order was read for the consideration at report stage of Bill C-42, An Act to amend the Aeronautics Act, as reported by the Standing Committee on Transport, Infrastructure and Communities with amendments.

Pursuant to Standing Order 76.1(5), the Speaker selected and grouped for debate the following motions:

Group No. 1

Mr. Jean (Parliamentary Secretary to the Minister of Transport, Infrastructure and Communities), seconded by Mr. Watson (Essex), moved Motion No. 1, — That Bill C-42, in Clause 2, be amended by replacing lines 7 to 15 on page 2 with the following:

“(4) The Committee of the House of Commons responsible for transport matters must,

(a) within three years after the day on which this subsection comes into force and every five years thereafter, commence a comprehensive review of the provisions and operation of this section, and complete the review within two years; and

(b) within three months after the day on which the review is completed, submit a report to the House of Commons setting out its findings.”

Mr. Jean (Parliamentary Secretary to the Minister of Transport, Infrastructure and Communities), seconded by Mr. Watson (Essex), moved Motion No. 3, — That Bill C-42, in Clause 2, be amended by replacing line 12 on page 2 with the following:

“the provisions and operation of this section; and”

Debate arose on the motions in Group No. 1.

Mr. McCallum (Markham—Unionville), seconded by Mr. Dhaliwal (Newton—North Delta), moved the following amendment to Motion No. 1, — That Motion No. 1 be amended by substituting paragraph (a) with the following:

“(a) within two years after the day on which this subsection comes into force and every five years thereafter, commence a comprehensive review of the provisions and operation of this section, and complete the review within one year; and”.
