The Standing Committee on Natural Resources met at 3:40 p.m. this day, in Room 371, West Block, the Chair, Leon Benoit, presiding.

 

Members of the Committee present: Mike Allen, David Anderson, Hon. Navdeep Bains, Leon Benoit, Paule Brunelle, Nathan Cullen, Claude Guimond, Russ Hiebert, Hon. Geoff Regan, Devinder Shory and Alan Tonks.

 

Acting Members present: Patrick Brown for Brad Trost.

 

Associate Members present: Cheryl Gallant.

 

In attendance: Library of Parliament: Jean-Luc Bourdages, Analyst; Mohamed Zakzouk, Analyst. House of Commons: Wayne Cole, Legislative Clerk; Lucie Tardif-Carpentier, Legislative Clerk.

 

Witnesses: Department of Natural Resources: Dave McCauley, Director, Uranium and Radioactive Waste Division, Electricity Resources Branch; Jacques Hénault, Analyst, Nuclear Liability and Emergency Preparedness. Department of Justice: Brenda MacKenzie, Senior Legislative Counsel, Advisory and Development Services Section.

 
Pursuant to the Order of Reference of Monday, June 1, 2009, the Committee resumed consideration of Bill C-20, An Act respecting civil liability and compensation for damage in case of a nuclear incident.
 

The witnesses made statements and answered questions.

 

The Committee commenced its clause-by-clause study of the Bill.

 

Pursuant to Standing Order 75(1), consideration of Clause 1 was postponed.

The Chair called Clause 2.

 

After debate, Clause 2 carried.

 

Clause 3 carried.

 

After debate, Clause 4 carried on division.

 

Clause 5 carried.

 

After debate, Clause 6 carried on division.

 

Clause 7 carried on division.

 

On Clause 8,

Nathan Cullen moved, — That Bill C-20, in Clause 8, be amended by replacing lines 1 and 2 on page 4 with the following:

“8. (1) An operator is liable for damage caused,”

 

The Chair ruled the proposed amendment inadmissible because it was contrary to the principle of the Bill, as provided on page 766 of House of Commons Procedure and Practice, Second Edition.

 

Whereupon, Nathan Cullen appealed the decision of the Chair.

The question: "Shall the decision of the Chair be sustained?" was put and the decision was sustained on the following recorded division: YEAS: Mike Allen, David Anderson, Navdeep Bains, Paule Brunelle, Claude Guimond, Russ Hiebert, Geoff Regan, Devinder Shory, Alan Tonks — 9; NAYS: Nathan Cullen — 1.

 

After debate, Clause 8 carried on the following recorded division: YEAS: Mike Allen, David Anderson, Navdeep Bains, Paule Brunelle, Claude Guimond, Russ Hiebert, Geoff Regan, Devinder Shory, Alan Tonks — 9; NAYS: Nathan Cullen — 1.

 

Clause 9 carried.

 

Clause 10 carried.

 

After debate, Clause 11 carried.

 

After debate, Clause 12 carried on the following recorded division: YEAS: Mike Allen, David Anderson, Navdeep Bains, Patrick Brown, Paule Brunelle, Claude Guimond, Russ Hiebert, Geoff Regan, Alan Tonks — 9; NAYS: Nathan Cullen — 1.
